Report of Commissioner appointed under "The Westland
Education District Subdivision Act, 1884."
To His Excellency Sir William Francis Drummond Jervois,
G.C.M.G., &c., Governor of New Zealand.
M AY IT PLEASE YOUR EXCELLENCY,—In pursuance of
your Excellency's Commission, dated the 22nd day
of November, 1884, directing and authorizing me to exercise
and fulfil the powers and duties set forth in subsections 1, 2,
3, 4, and 5 of section 7 of "The Westland Education District
Subdivision Act, 1884," I have now the honour to report,—
-
That I have ascertained and determined what personal
property belonged to the Education Board of the District of
Westland, as the same was constituted prior to the 31st day
of December, 1883, and that, as to the portion of such pro-
perty as is now in existence, I do hereby apportion and divide
the same between the Education Board of the District of
Westland and the Education Commissioners of the District
of Grey in the manner set forth in the First Schedule hereto. -
That I have made full inquiry concerning the contracts
entered into by the original Education Board of the District
of Westland, and in force at the commencement of "The
Westland Education District Subdivision Act, 1884," and
have ascertained what debts, liabilities, and engagements of
the said original Board were capable of being recovered or
enforced on the 31st day of December, 1883, or at any period
subsequent thereto up to the commencement of the said Act,
and that I do hereby award and determine: (1) That the
liabilities set forth in the Second Schedule hereto were in-
curred by the said original Board in respect of school build-
ings situated within the Education District of Westland as
now constituted, and that the same shall be borne by and
charged against the Education Board of the said District of
Westland; (2) That the liabilities set forth in the Third
Schedule hereto were incurred by the said original Board in
respect of school buildings situated within the Education Dis-
trict of Grey as now constituted, and that the same shall be
borne by and charged against the Education Commissioners of
the said District of Grey; (3) That the liabilities set forth in
the Fourth Schedule hereto were incurred by the said original
Board for school purposes within the Education District of
Westland as now constituted, and that the same shall be
borne by and charged against the Education Board of the
said District of Westland; (4) That the liabilities set forth
in the Fifth Schedule hereto were incurred by the said
original Board for school purposes within the Education
District of Grey as now constituted, and shall be borne by
and charged against the Education Commissioners of the
said District of Grey; (5) That the liabilities set forth in the
Sixth Schedule hereto were incurred by the said original
Board for general education purposes, and cannot be divided
in detail between the Education Board of the District of
Westland and the Education Commissioners of the District
of Grey, and that the total amount of the said liabilities
shall be divided between the said Education Board and the
said Education Commissioners in the proportion of four to
three, that is to say, the sum of six hundred and eighty-six
pounds eight shillings and twopence (£686 8s. 2d.) shall be
borne by and charged against the Education Board of the
District of Westland, and the sum of five hundred and four-
teen pounds sixteen shillings and one penny (£514 16s. 1d.)
shall be borne by and charged against the Education Com-
missioners of the District of Grey; (6) That the liabilities
set forth in the Seventh Schedule hereto are the balances
of the salaries and bonuses due for the year 1883 by
the said original Board to teachers of public schools within
the Education District of Westland as now constituted, after
the deduction from the said salaries and bonuses of the
moneys received by the said teachers from the sale of school
books and appliances intrusted to them for sale, and shall
be borne by and charged against the Education Board of the
District of Westland; (7) That the liabilities set forth in the
Eighth Schedule hereto are the balances of the salaries
and bonuses due for the year 1883 by the said original Board
to teachers of the public schools within the Education Dis-
trict of Grey as now constituted, after deduction from the
said salaries and bonuses of the moneys received by the said
teachers from the sale of school books and appliances
intrusted to them for sale, and shall be borne by and
charged against the Education Commissioners of the Dis-
trict of Grey. -
That a summary of the liabilities of the Education
Board of the District of Westland and the Education Com-
missioners of the District of Grey, as hereinbefore deter-
mined, is contained in the Ninth Schedule hereto. -
That I have ascertained the amount of moneys expended
and liabilities incurred by the Minister of Education, the
officers of his department, and other persons by his authority
in carrying on public education in the original Education
District of Westland subsequent to the 31st day of Decem-
ber, 1883, and up to the date when the Education Board and
the Education Commissioners respectively appointed by
"The Westland Education District Subdivision Act, 1884,"
took office; that the amount so ascertained is set forth in the
Tenth Schedule hereto; and that, as the amount of moneys
so expended and liabilities so incurred have already been
met by the amount that would have been payable by the
Crown to the original Education Board of the District of
Westland (if it had remained in office) out of moneys voted
by the General Assembly for the purposes of education within
the said district for the period herein specified, and by the
amount that would have been received by the Board from
other sources of revenue, it will not be necessary for the
Colonial Treasurer to make any deduction in respect of such
expenditure and liabilities from any subsidy or moneys here-
after payable by the Crown to the Education Board of the
