Defining the Middle Line of Further Portion of the Wellington-Napier Railway (Tamaki Contract, Portion of).

A PROCLAMATION.

WHEREAS the line of railway from Wellington to Napier (Tamaki Contract) is one of the railways specified in the First Schedule to “The Public Works Act, 1879,” and which Act is, in the seventh section thereof, declared to be a special Act authorizing the construction of such railway; and such railway is unfinished, and it has been determined to construct and maintain a further portion of the same:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred on me by the aforesaid section seven of “The Public Works Act, 1879,” and by sections one hundred and twenty-nine and one hundred and thirty of “The Public Works Act, 1882,” and in exercise of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that the middle line of the said further portion of the said railway shall be as defined and set forth in the Schedule hereto.

SCHEDULE.

COMMENCING at a point situate on the line of railway Napier to Woodville distant about 84 miles 40 chains from the Spit, and which point is on a portion of said railway, as proclaimed on the 23rd April, 1883, and published in the New Zealand Gazette No. 37, of the 3rd May, 1883, about 12 chains from the east bank of the Orouakeritaki River, Tahoraite Survey District, and proceeding in a generally south-westerly direction for a distance of 10 miles 58¼ chains or thereabouts, and passing in, into, and through or over the following lands, situate in the Waipawa County, Provincial District of Hawke’s Bay and Colony of New Zealand, viz.: Native Blocks Tahoraite No. 2 and Oringi Waiaruhe in the Tahoraite Survey District, and Crown land and the railway reserve in the Woodville Survey District, and including all adjoining and intervening places, lands, roads, reserves, streams, rivers, and watercourses, and terminating at a point on the said railway reserve marked 95 miles 75 chains; in the manner delineated on the plan marked P.W.D. 13084, and deposited in the office of the Registrar of the Supreme Court, at Napier, in the Provincial District of Hawke’s Bay; the total length being 10 miles 58¼ chains (the difference in mileage being caused by deviations).

Given under the hand of His Excellency Sir William Francis Drummond Jervois, Lieutenant-General in Her Majesty’s Army, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Companion of the Most Honourable Order of the Bath, Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-seventh day of May, in the year of our Lord one thousand eight hundred and eighty-five.

A PROCLAMATION.

WHEREAS the land described in the Schedule hereto is vested in certain aboriginal natives of New Zealand, subject to certain restrictions on the alienation of such land, and application has been made for the removal of such restrictions:

It is hereby notified that it is the intention of His Excellency the Governor, immediately after the expiration of sixty days from the publication of this notice in the Gazette and in the Kahiti, to remove the said restrictions on the alienation of the said land.

PORTIONS of Waotu North No. 2B Block, Waikato, containing together about 28 acres, proposed to be acquired by the Crown for educational and telegraph purposes, as delineated on the plan of the said block, deposited in the Survey Office, Auckland.

Order to take Land for the North Island Main Trunk Railway. Length about 210 miles.

ORDER IN COUNCIL.

At the Government House, at Wellington, this second day of April, 1885.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and in exercise of the powers vested in me by “The Public Works Act, 1882,” and of all other powers enabling me in that behalf, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby, with the advice and consent of the Executive Council of the said colony, order that a railway, having an average width of three hundred links, extending from a point on the right bank of the Puniu River, in the Provincial District of Auckland, to a point at the intersection of the railway-line from Foxton to New Plymouth Railway, situated in Section seven, Block three, Rangitoto Survey District, Provincial District of Wellington, shall be constructed on or through all lands held or occupied by Native owners; the total length being two hundred and ten miles or thereabouts: as delineated upon the plan marked P.W.D. 12069, deposited in the office of the Minister for Public Works, at Wellington, in the Provincial District of Wellington.

Notice of Intention to change the Purpose of a Portion of a Reserve.

WHEREAS by “The Public Reserves Act, 1881,” it is, amongst other things, enacted that the Governor may declare his intention to make, change, exchange, or alter the dedication of any public reserve now or hereafter vested in Her Majesty or the Governor for any of the purposes named in Class II. of the Schedule to the said Act, whether the same be granted or not; and, in the case of any reserves made under the authority of section one hundred and forty-four of “The Land Act, 1877,” if it shall, in the opinion of the Governor, be expedient to change the purpose of such reserves or any part thereof from the purpose or presumed purpose for which it was set apart to any other purpose, or if it shall, in the opinion of the Governor, be expedient to exchange any of the land comprised in such reserve for other land of equal value, to be dedicated to one or more purposes named in the said Class II., the Governor may, by notice in the Gazette, declare his intention to make such change, exchange, or dedication, as the case may be, and in such notice declare the manner and terms in which the same is intended to be so made:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby, in exercise and pursuance of the powers and authorities vested in me by “The Public Reserves Act, 1881,” aforesaid, declare my intention to change the specific purpose of a portion of the reserve described in the first column of the Schedule hereto, the area of which is described in the second column of the said Schedule, to the specific purpose set opposite such description in the third column of the said Schedule.
