Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the said reserve shall become vested in the Naseby Athenæum (Incorporated), in trust, for a site for an athenæum.

SCHEDULE.

ALL that parcel of land in the Provincial District of Otago, containing 26 perches, more or less, situate in the Township of Naseby, being Section No. 18, Block II., on the map of the said town. Bounded towards the North-west by Crown lands, 57 links; towards the North-east by Section No. 13, 156 links; towards the South-east by Derwent Street, 133 links; and towards the South-west by Section No. 12, 194 links.

Vesting Reserves in the Borough of Hamilton.

WHEREAS by section thirty-eight of “The Land Act 1877 Amendment Act, 1884,” it is provided that the reserves to be made for any borough or town district under such section shall be made only in cases where no such reserves for the purpose of sections three, five, and six of “The Plans of Towns Regulation Act, 1875,” exist therein, or, if existing, do not equal or exceed the amount of reserves authorized to be made under such last-mentioned Act:

And whereas the existing reserves for the Borough of Hamilton do not equal the amount of reserves authorized to be made under “The Plans of Towns Regulation Act, 1875,” and it appears expedient to make the reserves hereinafter mentioned:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon me by the thirty-seventh and thirty-eighth sections of “The Land Act 1877 Amendment Act, 1884,” and of all other powers enabling me in this behalf, do hereby declare that the lands enumerated in the first column of the Schedule hereto shall be and the same are hereby reserved for the purposes respectively stated opposite to the descriptions of such land in the second column hereto, for the benefit of the Borough of Hamilton, as constituted under the provisions of “The Municipal Corporations Act, 1876,” on the twenty-fourth day of December, one thousand eight hundred and seventy-seven.

Notice of Intention to change the Purpose of a Portion of a Reserve.

WHEREAS by “The Public Reserves Act, 1881,” it is, amongst other things, enacted that the Governor may declare his intention to make, change, exchange, or alter the dedication of any public reserve now or hereafter vested in Her Majesty or the Governor for any of the purposes named in Class II. of the Schedule to the said Act, whether the same be granted or not; and, in the case of any reserves made under the authority of section one hundred and forty-four of “The Land Act, 1877,” if it shall, in the opinion of the Governor, be expedient to change the purpose of such reserves or any part thereof from the purpose or presumed purpose for which it was set apart to any other purpose, or if it shall, in the opinion of the Governor, be expedient to exchange any of the land comprised in such reserve for other land of equal value, to be dedicated to one or more purposes named in the said Class II., the Governor may, by notice in the Gazette, declare his intention to make such change, exchange, or dedication, as the case may be, and in such notice declare the manner and terms in which the same is intended to be so made:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby, in exercise and pursuance of the powers and authorities vested in me by “The Public Reserves Act, 1881,” aforesaid, declare my intention to change the specific purpose of a portion of the reserve described in the first column of the Schedule hereto, the area of which is described in the second column of the said Schedule, to the specific purpose set opposite such description in the third column of the said Schedule.
