Provided that no light shall be exhibited until after it has
been approved of by the Minister.
-
That any person authorized by the Minister may, at all
reasonable times, enter upon the said wharf and any build-
ings erected thereon, and view the state of repairs thereof;
and that, upon such Minister leaving at or posting to the
last known address of the said Council a notice in writing of
any defect or want of repair in such wharf or buildings,
requiring it, within a reasonable time to be therein pre-
scribed, to repair the same, it shall, with all convenient
speed, cause such defect to be removed or such repairs to be
made. -
That the said Council shall not erect or suffer to be
erected on the said wharf any building or structure what-
ever, except with the consent of the Minister. -
That nothing herein contained shall authorize the said
Council to do or cause to be done anything repugnant to or
inconsistent with any law relating to the Customs, or any
regulation of the Commissioner of Trade and Customs, or
with any provisions of "The Harbours Act, 1878," or its
amendments, or any regulations made thereunder, and that
are now or may hereafter be in force. -
That the ballast of all vessels loading at the said wharf
shall be taken away by the said Council, and deposited above
high-water mark, or at such place as may be approved of by
the Minister. -
That the rights, powers, and privileges conferred by this
Order in Council shall continue in force for fourteen years,
computed from the date of this Order in Council, unless in
the meantime such rights, powers, and privileges shall be
altered, modified, or revoked by competent authority. -
That the rights, powers, and privileges conferred under
or by virtue of this Order in Council may be at any time
resumed by the Governor without payment of any compensa-
tion whatever, on giving to the said Council six calendar
months' previous notice in writing. Any such notice shall be
sufficient if given by the Minister, and delivered at the last
known address of the said Council. -
That the said Council shall not sell, mortgage, lease, or
otherwise part with, charge, or encumber the said wharf, or
any right or privilege hereby conferred upon it, without the
consent in writing of the Minister. -
Nothing contained in this Order in Council shall be
deemed to prevent its revocation at any time and without
any notice in case the said Council shall-
(1.) Commit or suffer a breach of the conditions herein-
before set forth, or any of them; or
(2.) Cease to use or occupy the said wharf.
And publication in the New Zealand Gazette of an Order in
Council containing such revocation shall be sufficient notice
to the said Council, and to all persons concerned or interested
in the said wharf, that this Order in Council, and the rights
and privileges thereby conferred, have been revoked and
determined.
- In these conditions the term "Minister" means the
Minister having charge of the Marine Department, as
defined by "The Shipping and Seamen's Act, 1877," and
includes any officer, person, or authority acting by or under
the direction of such Minister.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twelfth day of
June, 1883.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance and exercise of the powers vested in him by
"The Public Works Act, 1882," and of all other powers in
anywise enabling him in this behalf, His Excellency Sir
William Francis Drummond Jervois, the Governor of the
Colony of New Zealand, by and with the advice and consent of
the Executive Council of the said colony, doth hereby order
that the Government work known as the Cambridge-Rotorua
Road shall and may be constructed on or through the several
parcels of land more particularly described in the Schedule
hereto, and delineated in the plan marked P.W.D. 10013, de-
posited in the office of the Minister for Public Works at
Wellington, in the Provincial District of Wellington, in the
said colony.
SCHEDULE.
COMMENCING at a point on the south-eastern boundary of
Section No. 5 of Maraeroa-Oturoa Block, No. 5478, in the Roto-
rua Survey District, and proceeding thence in a generally south-
easterly direction for a distance of 8 miles 69 chains or there-
abouts, and terminating at a point on the Rotorua and Tauranga
Road, near the Ngungotaha Creek, passing in, into, through, or
over the following lands: Native land and Maniaroa-Puruha
Block, No. 5171: the above-described road not to be less than 1
chain wide; as the same is more particularly delineated upon
the plan marked P.W.D. 10013, deposited in the office of the
Minister for Public Works at Wellington, in the Provincial
District of Wellington.

IN pursuance and exercise of the powers and authorities
vested in me by the forty-fifth section of "The Ceme-
teries Act, 1882," I, William Francis Drummond Jervois, the
Governor of the Colony of New Zealand, do hereby appoint
the local authority specified in the first column of the Sche-
dule hereto to have the control and management of the public
cemetery specified in the second column of the said Sche-
dule.

mentioned as the same is deli-
neated on the plans in the Survey
Office, Auckland.
As witness the hand of His Excellency the Governor,
this ninth day of August, one thousand eight hun-
dred and eighty-three.
