Setting apart Land in Westland for Agricultural Lease.

A PROCLAMATION.
WHEREAS by the fifty-fourth section of "The Mines Act
1877," it is, amongst other things, enacted that it shall
be lawful for the Governor to cause Crown lands situate within
a gold field to be selected and set apart for the purpose of
granting agricultural leases thereon and therefor, or for aliena-
tion by occupation licenses on deferred payments, under any
law for the time being in force in the land district in which such
mining district is situate :
And whereas the land described in the Schedule hereto is
Crown land subject to be dealt with under the provisions of
the said Act, and it is deemed expedient to set the same apart
for the purpose of granting an agricultural lease thereon and
therefor :
Now, therefore, I, William Francis Drummond Jervois, the
Governor of the Colony of New Zealand, do hereby select and set
apart, for the purpose of granting an agricultural lease thereon
and therefor, the land described in the Schedule hereto; and do
fix the twenty-fifth day of July next ensuing, at the office of
the Commissioner of Crown Lands at Hokitika, as the day and
place on which the said land shall be open for application in one
allotment, as surveyed and marked on the survey map in the
said office.
SCHEDULE.
ALL that parcel of land situated in Block XII., Hohonu Survey
District, opposite the junction of Pirami or Dobson's Creek with
the Teramakau River, containing 50 acres, more or less.
Bounded on the East by the Teramakau River; and on the
West and North by a swamp and an overflow channel of the
Teramakau River: exclusive of necessary reserves and rights
granted under the Mines Act.
Given under the hand of His Excellency Sir William
Francis Drummond Jervois, Lieutenant-General in
Her Majesty's Army, Knight Grand Cross of the
Most Distinguished Order of Saint Michael and
Saint George, Companion of the Most Honourable
Order of the Bath, Governor and Commander-in-
Chief in and over Her Majesty's Colony of New
Zealand and its Dependencies, and Vice-Admiral
of the same; and issued under the Seal of the said
Colony, at the Government House, at Wellington,
this fifth day of June, in the year of our Lord one
thousand eight hundred and eighty-three.

ment Act, 1882."

ORDER IN COUNCIL.
At the Government House, at Wellington, this fifth day of
June, 1883.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance and exercise of the powers and authorities con-
ferred upon him by "The Land Act 1877 Amendment Act,
1882," His Excellency the Governor of the Colony of New
Zealand, acting by and with the advice and consent of the
Executive Council of the said colony, doth hereby make and
prescribe the following regulations as those upon which all
leases of lands and education reserves set apart for leasing under
the said Act, shall be prepared under the authority of section
sixteen of the said Act, namely:-
Every deed shall be prepared by the Commissioner of Crown
Lands for the district in which the lands to be leased are
situated, and shall be in the form and contain the covenants,
conditions, and agreements (as nearly as may be) set forth in
the Schedule hereto.
SCHEDULE.
THIS deed, made the day of , 18, between the
Land Board of , in the Colony of New Zealand (which
said Board, with its successors and assigns, is hereinafter termed
"the lessor"), of the one part, and , of , in the Pro-
vincial District of , in the said colony, , who, with
executors, administrators, and permitted assigns,
(hereinafter referred to as and included in the term "the
lessee"), of the other part, witnesseth that, in consideration of
the rent hereinafter reserved, and of the covenants, conditions,

and agreements herein contained and implied, and on the part
of the lessee to be paid, observed, and performed, the lessor
doth hereby demise and lease unto the lessee all that piece or
parcel of land containing by admeasurement , a little
more or less, situate in the District of aforesaid, and being
Section , Block , Survey District of ;
as the same is more particularly delineated and described in the
plan drawn hereon, and therein coloured red in outline; together
with the rights, easements, and appurtenances to the same belong-
ing. To hold the said several premises intended to be hereby
demised unto the lessee for the term of thirty years, com-
mencing as from the 30th day of June, 18, and renewable on
the conditions prescribed by "The Land Act 1877 Amendment
Act, 1882." Yielding and paying therefor unto the Receiver
of Land Revenue for the said District of the annual rent
of £ , payable half-yearly in advance on the 1st day of
January and the 1st day of July in each and every year during
the said term, free from all deductions whatsoever. The first
payment of such rent having been made, the next payment to
become due to be made on the day of next.
And it is hereby declared and agreed that these presents
are intended to take effect as a lease under "The Land Act
1877 Amendment Act, 1882," and the provisions of that statute
shall be binding in all respects upon the parties hereto
in the same manner as if such provisions had been fully
set out herein; and that if any dispute or disagreement
shall arise between the parties hereto touching the con-
struction of these presents, or in anywise relating hereto,
such dispute or disagreement shall be referred to arbitration
in the manner set forth in section 45 of the said last-mentioned
Act; and neither of the said parties shall take or cause to be
taken any steps or proceedings to set aside or call in question
any award or decision which may have been given upon any
such reference as final.
In witness whereof the Commissioner of Crown Lands for
the Land District of , on behalf of the lessor, hath
hereunto set his hand; and these presents have been also
executed by the said lessee, this day of , 18 .

Authorizing Sale of Reserves.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fifth day of
June, 1883.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by "The Special Powers and Contracts Act,
1881," it is enacted that the Governor may, by Order in
Council, authorize the sale of Reserves four hundred and
twenty-four, one thousand two hundred and sixty-three, and
one thousand eight hundred and twenty-four, in the Provincial
District of Canterbury, in such lots and on such conditions as
may be prescribed by the said Order in Council: And whereas
by an Order in Council dated the 20th March, 1883, certain
allotments were fixed, and conditions of sale prescribed: And
whereas it is expedient to revoke the aforesaid Order in Council
and to make other provision in lieu thereof:
Now, therefore, His Excellency the Governor, in pursuance
of the power and authority conferred upon him by the herein-
before in part recited Act, and by and with the advice and con-
sent of the Executive Council of the Colony of New Zealand,
doth hereby revoke the aforesaid Order in Council, and doth
by this present Order fix the allotments and prescribe the con-
ditions under which the reserves enumerated in the Schedules
hereto shall be sold, viz. :-
- The reserves above mentioned shall be sold in allotments as
shown on the official map in the Survey Office, Christchurch. - The lands enumerated in the First Schedule hereto shall
be sold by auction as village allotments, on immediate payment,
for cash, at the upset prices stated therein, and at such time and
place as the Land Board may appoint, of which three months'
notice shall be given. - The lands enumerated in the Second Schedule hereto shall
be sold at the prices stated therein, as small-farm allotments, on
deferred payments, subject to the provisions of Part III. of
"The Land Act, 1877," relating to suburban land, and to the
