Notifying Sections of Waimate Railway to be completed and
opened for Traffic.

WHEREAS by section four of “The District Railways Acts
Amendment Act, 1882,” it is enacted that whenever any
complete part or section of any railway shall be fit to be used
for the purposes of traffic, then and in every such case the
Governor may, by notice gazetted, notify that such complete
part or section is so fit to be used, and the same may be used
accordingly; and the provisions of “The District Railways Act,
1877,” with respect to the management of railways shall extend
and be made applicable to every complete part or section so
notified as fit to be used: And whereas by section five it is
enacted that a gazetted notification by the Governor that a
railway or any complete part or section of a railway, as the case
may be, is fit to be used for the purposes of traffic, and of the
date on which the same respectively became so fit to be used,
shall be conclusive evidence for the purposes of “The District
Railways Act, 1877,” and “The District Railways Acts
Amendment Act, 1882,” that such railway or such complete
part or section of a railway, as the case may be, is so fit to
be used, and of the date on which the same respectively became
so fit: And whereas by section six of the said “District Rail-
ways Acts Amendment Act, 1882,” it is further enacted that
the date on which a railway or any complete part or section of
a railway was or shall be first opened for traffic, or was or shall
be closed or reopened for traffic, may be notified by the Governor
by notice gazetted, and such gazetted notification shall be con-
clusive evidence of the fact and date of such opening, closing,
or reopening as aforesaid:
And whereas the sections of the Waimate Railway, from Wai-
mate to Waihao Downs, hereinafter mentioned, being together
a distance of eight miles and fourteen chains, have been com-
pleted, and are fit to be used for the purposes of traffic:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in exercise of the powers and authorities con-
ferred by the above-recited sections, and of every other power
and authority in anywise enabling him in that behalf, doth
hereby notify that the Waihao Section of the Waimate Railway
(as constructed in terms of the Governor’s assent, dated the
twenty-sixth day of February, one thousand eight hundred and
seventy-nine), being a length of seven miles and four chains, has
been completed, and further that the said section of railway is,
and on the twentieth day of January, one thousand eight
hundred and eighty-three, became, fit to be used for the pur-
poses of traffic, and was on the sixteenth day of February, one
thousand eight hundred and eighty-three, first opened for
traffic; and, by the like authority, doth hereby notify that the
Waihao Downs Section of the said railway, being a length of one
mile and ten chains, has been completed, and further that the
said Waihao Downs Section is, and on the sixth day of April,
one thousand eight hundred and eighty-three, became, fit to be
used for the purposes of traffic, and was on the twenty-fourth
day of April, one thousand eight hundred and eighty-three,
first opened for traffic.
As witness the hand of His Excellency the Governor,
this ninth day of May, one thousand eight hundred
and eighty-three.

Setting apart Land as an Endowment for the Auckland
Museum.

IN pursuance and exercise of the powers and authorities
conferred upon me by the second section of “The Auck-
land Museum Endowment Act, 1882,” I, William Francis
Drummond Jervois, the Governor of the Colony of New Zealand,
do hereby select and set aside from the Crown lands situate
within the Auckland Land District the blocks of Crown lands
which are enumerated in the Schedule hereto as an endowment
for the Auckland Museum.
The said lands do not exceed in value the sum of ten thousand
pounds, and shall be classified under the provisions of “The
Land Act, 1877.” This notification, that the said lands have
been so set aside, is made pursuant to the terms of the first-
mentioned Act.
