Land taken by the Borough of Mornington for the
Purposes of a Road.

A PROCLAMATION.
WHEREAS by "The Municipal Corporations Act,
1876," it is enacted that the Council of a
borough constituted under that Act may take any
land within the borough for any of the purposes of
that Act in the manner provided by the second part
of "The Public Works Act, 1876" (hereinafter called
"the said Act"): And whereas the Council of the
Borough of Mornington, requiring to take the land
described in the Schedule hereto for the purposes of
a road, has laid before me the memorial referred to
by section twenty-five of the said Act, praying me to
declare, by Proclamation, that such land is taken for
such purpose:
And whereas the Council of the said borough has,
in accordance with the twenty-eighth section of "The
Public Works Act 1876 Amendment Act, 1878," laid
before me a statutory declaration that the said Coun-
cil is authorized by law to undertake the work for
which the land described in the memorial laid before
me under section twenty-five of the said Act is re-
quired, that all the provisions of the said Act as to
taking such land have been complied with, and that
the said Council are of opinion that the proposed
works should be executed, and that no private injury
will be done for which due compensation is not pro-
vided by the said Act:
And whereas it appears to me that all things required
by the said "Municipal Corporations Act, 1876,"
"The Public Works Act, 1876," and "The Public
Works Act 1876 Amendment Act, 1878," to be done
and performed to authorize the taking of such land
have been done and performed, and it is expedient to
declare that such land is taken for the purpose afore-
said:
Now, therefore, I, James Prendergast, the Ad-
ministrator of the Government of the Colony of New
Zealand, by and with the advice of the Executive
Council of the said colony, in exercise and in pursu-
ance of the powers and authorities in me vested by
the said Acts, and of any other power and authority
enabling me in that behalf, do hereby proclaim and
declare that the land described in the Schedule hereto
is taken by the Council of the said borough for the
purposes of a road, and that, from and after the
thirtieth day of September, one thousand eight hun-
dred and eighty, the said land shall become vested
in fee-simple in the Mayor, Councillors, and Bur-
gesses of the Borough of Mornington, discharged
from all mortgages, charges, claims, estates, and
interests of what kind soever, for the purposes of a
road as aforesaid.
SCHEDULE.
ALL that parcel of land situate in the Township of
Richmond Hill, being part of Section 11, Block I., on
the map of the said township, commencing at a point
in Laurence Street, being the most south-western
corner of said Section 11, running thence in an east-
south-easterly direction, 231 links; thence in a north-
north-easterly direction, 60 links; thence in a west-
north-westerly direction, 231 links; and thence in a
south-south-westerly direction, 60 links, home to the
commencing point: Also all that parcel of land
situate in the Town of Mornington, being part of
ERRATA. In the Supplement to the New Zealand Gazette No. 77, of 10th August, 1880, page 1179, Notices of Decisions of
John Rogan, Esq., Judge, Native Land Court, at Helensville, Kaipara, for name of owner of Tuparakura No. 1, "Pato-
romu Taliuora," read "Patoromu te Akariri;" and for name of owner of Tuparakura No. 2, "Patoromu Tahuora," read
"Ihapera Nerihona."
