Appointing Trustees under "The Maori Real Estate Management Act Amendment Act, 1867."
HERCULES ROBINSON, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-seventh day of May, 1880.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by "The Maori Real Estate Management Act, 1867" (hereinafter called "the said Act"),
it is enacted that, if any title to or interest in any hereditaments shall accrue to any Maoris, who or
any of whom shall be infants, lunatics, or under legal disability, it shall be lawful for the Governor in
Council, if he think fit, to order that such hereditaments, or any part thereof or interest therein, as shall
be shown to belong to such infant, or lunatic, or other person under legal
disability, shall be vested in trustees, as the Governor in Council shall think fit:
And whereas at a sitting of the Native Land Court of New Zealand, held at Kaiapoi, in the County of
Ashley, and the Provincial District of Canterbury, on the twenty-seventh day of March, one thousand eight
hundred and eighty, in pursuance of an Order in Council, made on the fourteenth day of October, one
thousand eight hundred and seventy-nine, under and by virtue of "The Kaiapoi Native Reserves Act, 1877,"
certain orders were made by the Court awarding the several parcels of land set forth and described in the
First Schedule to the lastly afore-recited Act, and referred to in the first column of the Schedule hereto,
to the several aboriginal Natives in the said several orders named :
And whereas certain interests in the several parcels of land aforesaid, or some of them, accrued thereby
to the several persons, amongst others, being minors or lunatics, whose names are set forth in the second
column of the Schedule hereto:
And whereas by "The Maori Real Estate Management Act Amendment Act, 1877," it is provided
that, in all cases in which no trustee of such estate of any infant Maori, prior to the passing of the said Act,
has been appointed, the Governor may appoint such trustee only on the recommendation of a Judge of the
Native Land Court:
And whereas it is expedient that trustees should be appointed, under the first afore-recited Act, and the
amendment thereof, on behalf of the said minors and lunatics, for such time as their minority or other legal
disability shall continue:
And whereas, in pursuance of other orders of the Native Land Court aforesaid, bearing even date
with the orders hereinbefore referred to, made by John Jermyn Symonds, Esquire, one of the Judges of the
said Court, certain persons therein named were recommended to the Governor as trustees under the said
Acts on behalf of the minors and lunatics therein named in respect of the said lands or some of them:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, with the advice and
consent of the Executive Council of the colony, in exercise and pursuance of the powers and authorities vested
in him by the said first afore-recited Act and the amendment thereof, doth hereby order that the interests
and shares of the said minors and lunatics named in the second column of the Schedule hereto annexed in
the several parcels of land named in the first column thereof shall be and remain vested in the persons
whose names are set opposite to theirs respectively in the third column of the same as trustees, within the
meaning and for the purposes of the said Acts, for the said minors and lunatics, during the term or terms
of their minority and the continuance of their lunacy or other legal disability, the said several parcels of
land having the areas and boundaries set forth in the Schedule to "The Kaiapoi Native Reserves Act,
1877," above referred to, and in the record maps in the office of the Surveyor-General.
