Order in Council, the said district shall comprise and
include all islands nearest thereto which were not
so included by the said Order in Council.

That, in addition to the contents of the Land-Tax
District of Wellington, as set forth in the said Order
in Council, the said district shall comprise and include
all islands nearest thereto which were not so included
by the said Order in Council.

That, in addition to the contents of the Land-Tax
District of Nelson, as set forth in the said Order in
Council, the said district shall comprise and include
all islands nearest thereto which were not so included
by the said Order in Council.

That, in addition to the contents of the Land-
Tax District of Canterbury as set forth in
the said Order in Council, the said district
shall comprise and include all islands nearest
thereto which were not so included by the said Order
in Council.

That, in addition to the contents of the Land-
Tax District of Otago as set forth in the
said Order in Council, the said district shall
comprise and include all islands nearest thereto
which were not so included by the said Order in
Council.

And with the like advice and consent I do hereby
order and declare that this Order in Council shall
come into operation on the twenty-second day of
January instant.

Regulations for Electing Members of Harbour
Boards.

NORMANBY, Governor.
ORDER IN COUNCIL.

At the Government House, at Wellington, this
twenty-first day of January, 1879.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

W
HEREAS it is enacted by the thirty-fifth section
of "The Harbours Act, 1878," that all elec-
tions of members of Harbour Boards, other than
those to be made by ratepayers, shall be held in such
manner as may be prescribed by the special Act, and,
if no provision be made in that behalf, then in such
manner as the Governor in Council shall from time
to time direct by regulations to be made for that
purpose:

And whereas it is expedient to make regulations
providing for the manner of electing members of
Harbour Boards where no provision has been made
as to the manner of holding such elections:

Now, therefore, His Excellency the Marquis of
Normanby, Governor of New Zealand, in pursuance
and exercise of the power and authority vested in him
by the said recited Act, and by and with the advice
and consent of the Executive Council of the colony,
doth hereby order and direct that the following
regulations shall take effect for the election of mem-
bers of Harbour Boards in the cases hereinbefore
mentioned, that is to say,-

REGULATIONS.

  1. Whenever it is necessary to elect a member of
    a Harbour Board constituted under "The Harbours
    Act, 1878," by a local governing body, or by any
    other body or association having power to do so, such
    election shall be held at a meeting of the local govern-
    ing body, or other body or association (hereinafter
    called the "electing body"), of which notice shall have
    been given in the same manner as notices of the meet-
    ings of such electing body are usually given, and in
    such notice the object of the meeting shall be stated.

For the purposes of these regulations the ex-
pression "local governing body" shall have the
like meaning as assigned to such expression in
"The Harbours Act, 1878."

  1. On the day fixed by law to hold the election, and
    at the meeting of the electing body, the names of the
    candidates being stated by the Chairman, each candi-
    date shall be proposed by one member and seconded
    by another member of the electing body on the day
    fixed by law to hold the election. The Chairman at
    any such meeting of the electing body may be any
    person who would be entitled or might be appointed
    to act as Chairman at the ordinary meetings of such
    body.

  2. After the candidates for election have been pro-
    posed and seconded, the Chairman of the meeting
    shall call for votes by a show of hands for each can-
    didate in order of proposal.

  3. The candidates getting the largest number of
    votes shall be elected.

  4. In the case of there being an equality of votes
    the Chairman of the meeting shall have a casting
    vote. Such Chairman shall have a casting vote but
    not a deliberative vote.

  5. Where members of a Harbour Board are required
    to be elected by the payers of dues and the owners of
    ships, a meeting of the said electors shall be held at
    the Harbour Board Office on the day fixed by law
    at a time to be fixed, and which shall be publicly
    notified under the hand of the Chairman of the
    Harbour Board, and at such meeting the members
    shall be elected by show of hands in like manner as
    hereinbefore provided for the election of members of
    Harbour Boards by local governing bodies.

If there be any vacancy in the office of Chairman,
then such meeting may be called by the Secretary or
Clerk of the Board, or other officer discharging the
duties of such Secretary.

  1. Any such meeting shall have power to elect its
    own Chairman, and he shall have a casting but not a
    deliberative vote, and shall decide all questions of
    qualification as to vote by causing the claimant then
    and there to produce receipts in his favour for the
    dues required to be paid by him to qualify him to be
    an elector, or a certificate of ownership or other suf-
    ficient document from the Registrar of Shipping or
    other proper officer, as the case may require.

  2. The decision of the Chairman of any meeting,
    whether as to any election of a member of the
    Board or as to the proof of any qualification as
    aforesaid, shall be final and conclusive on all parties.

HEREAS it is provided by the forty-sixth
section of "The Harbours Act, 1878," that,
if at any time it shall be made to appear to the
Governor that a local governing body or association
electing or appointing a member or members of a
Harbour Board has ceased to exist, or has been
incorporated with or united to some other local
governing body or association, the Governor may, by
Order in Council, declare what other local governing
body or association shall return a member in lieu of
