Defining the Middle Line of Portions of the Railway
from Waikato to the Thames, including Branch
Line to Hamilton.

A PROCLAMATION.
WHEREAS by the one hundred and twenty-
second section of "The Public Works Act,
1876," it is enacted that every railway shall be made
only under the authority of a special Act, which
shall state as nearly as may be the line of the railway
and the two termini thereof; and, by the one hundred
and twenty-fourth section of the same Act, that when
any railway is to be constructed under the provisions
of any special Act the Governor shall issue a Pro-
clamation defining the middle line of the railway or
any part thereof, and may from time to time, by a
Proclamation revoking or amending such former
Proclamation, alter such line in any manner or to
any extent which may be found necessary for the
construction of such railway within the provisions of
the said special Act; and, by the one hundred and
twenty-fifth section of the same Act, that the
Minister shall cause to be made and deposited in the
office of the Registrar of the Supreme Court such
maps and plans as may be necessary to explain the
said line and the land through which the same passes,
and such maps and plans shall be referred to in any
such Proclamation: And whereas the railways from
Waikato to the Thames and the Branch Line to
Hamilton are specified in "The Immigration and
Public Works Appropriation Act, 1878," and which
Act is therein declared to be a special Act for the
said railways within the meaning of "The Public
Works Act, 1876:" And whereas it has been deter-
mined to construct and maintain portions of the said
railways—namely, from a point in Lot 1, Parish of
Te Rapa, Hamilton Highway District, and termin-
ating at a point fifty-five (55) chains or thereabouts
distant from the south-western boundary line of the
Waikato Swamp Company's land; also commencing
at the Goods Wharf, Grahamstown, and terminating
at a point on the south bank of the Kauaeranga
River:
Now, therefore, I, Sir Hercules George Robert
Robinson, the Administrator of the Government of
the Colony of New Zealand, in exercise and in pur-
suance of the powers and authorities conferred on me
by "The Public Works Act, 1876," and in exercise of
every other power and authority enabling me in that
behalf, do hereby proclaim and declare that the middle
line of the said portions of such railways shall be that
defined and set forth in the Schedule hereto. The
said middle line and the land through which the
same passes are set forth in the map and plan
marked P.W.D. 6921, and authenticated for the pur-
poses of this Proclamation by the signature of the
Honorable James Temple Fisher, Minister acting for
the Minister for Public Works, and which said map
and plan is deposited in the office of the Registrar
of the Supreme Court at Auckland, in the Pro-
vincial District of Auckland.
SCHEDULE.
COMMENCING at a point in Lot 1, Parish of Te Rapa,
Hamilton Highway District, the said point being
within the limits of deviation of a portion of the
railway from Newcastle southwards, as described in
the Proclamation dated the 26th January, 1875, and
published in the New Zealand Gazette No. 6, of 28th
January, 1875, and proceeding thence in a generally
north-easterly direction for a distance of five (5)
miles or thereabouts, passing in, into, or through, or
over the following lands, &c.: Hamilton Highway
District, Parish of Te Rapa, Lot 1; Hamilton West
Highway District or Borough of Hamilton, Township
of Hamilton west, Lots 106, 107, 108, 109, 39, 40,
41, 42, 43, 44, 45, 46, and 47; Waikato River; Kiri-
kiriroa Highway District, Parish of Kirikiriroa, Lots
219, 221, 223, 223A, 304, 240, 239, 238, 241, 242, and
302, and terminating at a point fifty-five (55) chains
or thereabouts distant from the south-western boun-
dary line of the Waikato Swamp Company's land;
including all adjoining and intervening places, Crown
lands, lands, roads, reserves, streams, rivers, and
watercourses; all within the Provincial District of
Auckland, Colony of New Zealand; in the manner
delineated on the map and plan marked P.W.D.
6921, signed by the Honorable James Temple Fisher,
Minister acting for the Minister for Public Works,
deposited in the office of the Registrar of the
Supreme Court at Auckland, in the Provincial Dis-
trict of Auckland, Colony of New Zealand; the
total length being five (5) miles, or thereabouts.
