Rules under "Land Claims Settlement Act, 1856,"
altered.

approve of the following alterations in the
rules established under "The Land Claims Settle-
ment Act, 1856," made in pursuance of the powers
vested in me by the seventh section of the said Act.

NORMANBY, Governor.
WHEREAS it is enacted by "The Land Claims
Settlement Act, 1856," that the Commissioners
appointed to carry the said Act into effect shall frame
and establish rules for the sittings of the Land
Claims Court and notices thereof, the notification of
proceedings, and generally for the conduct of busi-
ness under the said Act, and may from time to time
alter such rules; and that all such rules, and all
alterations thereof, shall be submitted to the Governor
in Council for approval: And whereas certain rules
were framed and established by Francis Dillon Bell,
Esquire (now Sir Francis Dillon Bell, Knight), a
Commissioner appointed under the said Act, approved
of by the Governor in Council, and published in the
New Zealand Gazette on the 8th September, 1857:
And whereas it is expedient to alter such of the said
rules as relate to the execution of surveys under the
said Act-namely, Rules Nos. 15 and 16:
Now, therefore, I, Robert Stout, Commissioner of
Land Claims, in exercise and pursuance of the power
vested in me by the said in part recited Act, do
hereby declare the said Rules numbered 15 and 16
respectively to be revoked and annulled, and the fol-
lowing rules substituted in lieu thereof:-

In lieu of Rule No. 15.
Every survey made by a claimant must be executed
by an authorized surveyor, and in compliance with
the subjoined regulations :-

  1. When a surveyor undertakes a survey for a
    land claimant, he must immediately inform the Chief
    Surveyor of the district thereof, and must execute
    the survey in accordance with his instructions.
  2. All surveys must be in the true meridian of
    the circuit placed in correct position within the
    survey district in which they are situated.
  3. Boundary surveys of areas over 3,000 acres
    in extent may be made by the system of converging
    angles observed between fixed and known points, the
    intervening and adjacent features being delineated
    by cross bearings, or theodolite or compass chain
    traverses.
  4. Surveys under 3,000 acres in extent must be
    triangulated and traversed, or traversed only if trian-
    gulation be inapplicable by reason of the denseness
    of the forest.
  5. When true bearing is not obtainable, then only
    may surveys be executed on magnetic bearing, and
    when this is had recourse to the reasons must be
    stated on the face of the plan.
  6. All boundaries must be permanently ground-
    marked by pegs, lockspits, mounds, cairns, witness
    marks on trees or on rocks, so that the corners and
    lines may be clearly indicated for future inspection.
  7. Field-books must be kept in ink, and delivered
    up to Government when completed, or when the
    surveyor has done with his work.
  8. Plans to be drawn according to specimens to
    be seen in the office of the Chief Surveyor of the
    district; the scales used being 2, 5, 10, 20, 40, or
    80 chains to an inch, according to extent.
  9. The plan must show the natural features of
    the land in the claim and any roads or tracks in use,
    and indicate the most likely course of future main
    through roads, and must also show the dividing lines
    of any contiguous blocks or sections.
  10. The names of the natural features must be
    given on the plan, as also the names of the adjoining
    blocks (if any), and of the owners thereof.
  11. All theodolite, and chain, triangular, or tra-
    verse work to be mathematically reduced on the
    meridian and perpendicular, a table of which is to
    accompany each plan.
    NOTE. The term "authorized surveyor" signifies a sur-
    veyor who has been approved of by the Surveyor-General as
    qualified.

In lieu of Rule No. 16.
The plans of each claim must be in duplicate (one
on paper and one on tracing cloth), and bear upon
them the certificate of the surveyor that the survey
was completed without disturbance from the Natives,
and that all the boundary lines have been properly
marked upon the ground. The plans must also be
certified as correct by the Chief Surveyor of the
district, and, upon such certificate of correctness
being obtained, the paper plan of the claim shall be
deposited by the surveyor in the office of the Chief
Surveyor, and the tracing shall be forwarded to the
Land Claims Commissioner.
