Person entitled to Land under "The Immigrants
Land Act, 1875."

ORDER IN COUNCIL.
At the Government House, at Auckland, this
sixth day of March, 1878.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by "The Immigrants Land Act
Amendment Act, 1875," it is enacted that in
any case where any person who, since the passing of
"The Immigrants Land Act, 1873" (hereinafter re-
ferred to as "the said Act"), and prior to the coming
into operation of the now reciting Act, has paid his
own passage to the colony with the intention of
settling upon and cultivating land therein, and who
has omitted to obtain any certificate or to do any
other act by the said Act required to entitle him
to a free grant of land thereunder, whether such
omission shall have occurred prior to or after arrival
in the colony, it shall be lawful for the Governor, by
Order in Council, on receiving proof that such person
had a bonâ fide intention to comply with the said Act,
to direct and declare that such person shall have and
be entitled to all the privileges and benefits which
he would have had under the said Act but for such
omission as aforesaid: And, further, that every such
Order in Council shall state specifically the nature of
the omission in respect of which such order shall be
made, and shall be forthwith published in the New
Zealand Gazette; and thereupon the person named
in such Order in Council shall have all the privileges
and benefits which he would have had but for such
omission as aforesaid:
And whereas proof has been received by the
Governor that the person mentioned in the first
column of the Schedule hereto has paid his own
passage to the colony with the intention of settling
upon and cultivating land therein, and also that he
had a bonâ fide intention to comply with the said
Act, but has omitted to do the acts mentioned in the
second column of the said Schedule, by the said Act
required to entitle him to a free grant of land there-
under:
Now, therefore, His Excellency the Governor, by
and with the advice and consent of the Executive
Council of the Colony of New Zealand, and in
exercise and pursuance of the power and authority
vested in him by the said "Immigrants Land Act
Amendment Act, 1875," doth hereby direct and
declare that the person mentioned in the first column
of the Schedule hereto shall have and be entitled to
all the privileges and benefits which he would have
had under the said Act but for such omission as
aforesaid.

Making Rules for Surveys, and Fees to be paid by
Applicants for Land, under "The Land Act,
1877"-Auckland District.

ORDER IN COUNCIL.
At the Government House, at Auckland, this
sixth day of March, 1878.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the 169th section of "The Land
Act, 1877," it is, among other things, enacted
that the Governor shall have power from time to
time to make rules, regulations, and orders providing
for the mode by which any land or allotment shall be
surveyed and boundaries adjusted, and for imposing
any reasonable charge for surveys:
And whereas it is expedient that a charge should
be made for the survey of rural lands to be occupied
within the Land District of Auckland under the pro-
visions set forth in clauses 2 and 3, Appendix A, of
the said Act, upon the scale and in manner herein-
after mentioned:
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in provision and exercise of the
powers vested in me by the said Act, do hereby make
the rules, regulations, and orders set forth in the
Schedule hereto, providing the mode in which surveys
may be made, and for imposing the fees to be paid
by persons making application for land to be occupied
under the provisions set forth in clauses 2 and 3 of
the Appendix to the said Act.
SCHEDULE.

All surveys shall be made by surveyors authorized
by the Surveyor-General, and in accordance with in-
structions to settlement surveyors issued, or which
may be issued, by him. -
There shall be paid for the survey of any area—

Whenever two or more sections are surveyed
together by the same surveyor, one-third of the
above rates shall be deducted for all areas above 50
acres, and whenever also more than one-half the
length of the boundary lines shall run through
vegetation less than 6 feet high, one-third of the
schedule rates shall be deducted. -
All fees so chargeable shall be deposited with
the Receiver of Land Revenue at the time the
application for land is made. -
These regulations shall come into force and
take effect on and from the publication thereof in
the New Zealand Gazette.
