On all trucks not unloaded by the con-
signees within four working hours of their

Notice is also hereby given that the minimum
number of trains to be run daily shall be two trains
each way daily, Sundays excepted.
And notice is also hereby given that the rates it is
proposed to levy pursuant to the provisions of the
said Act in respect of the lands above classified are
as follow:--
In respect of the lands of the first class a rate
sufficient to produce £3 per centum per
annum on the cost of the proposed railway
and equipment thereof.
And in respect of the lands of the second class a
rate sufficient to produce £2 per centum per
annum on such cost.
The registered office of the said Company is at
Waimate, in the Provincial District of Canterbury,
where all communications may be addressed.

Kingdom of Great Britain and Ireland,
Queen.
To JAMES DAY, Master of the brig "Star," of Bal-
timore, in the United States of America, now lying
in the Port of Lyttelton, in the Colony of New
Zealand; WALTER TURNBULL, of the City of
Wellington, in New Zealand, Merchant, trading
under the firm or style of "W. and G. Turnbull
and Co.;" and to CHARLES EFFINGHAM CAPPER, of
the City of Wellington aforesaid, Clerk.
WHEREAS an action was, on the seventeenth
day of October, one thousand eight hundred
and seventy-eight, commenced in our Supreme Court
of New Zealand, at the suit of Joseph Edward
Nathan, of the City of Wellington, Merchant,
trading under the name and style of "Joseph Nathan
and Co.," against Heinrich Hellmers, of Baltimore,
aforesaid, Shipowner, who is not within the said
colony, wherein the said plaintiff claims to recover
from the defendant the sum of two hundred and
eighteen pounds eighteen shillings and eight-pence:
And whereas a copy of the writ in the said action
and of the declaration annexed thereto, together with
an affidavit verifying the matters contained in the
said declaration, and showing that the cause of
action arose in respect of the breach of a contract to
be partly performed in the said colony, and that the
defendant is not within the said colony, have been
filed in our said Court: And whereas we are
informed that you, the said James Day, and you, the
said Walter Turnbull and Charles Effingham Capper,
respectively, or some or one of you, now have
respectively in your charge or under your control
certain property and moneys belonging to the de-
fendant, being the said brig "Star," with the boats,
tackle, furniture, and apparel of the same, and
moneys received and receivable by you or some one
of you for freight on goods carried in the said ship:
Now we hereby command you and each of you that,
after the service of this writ upon you, and until the
same shall be dissolved, you do not knowingly dispose
of or part with any part of the said property or
moneys, excepting only to the use of the plaintiff in
this action.

tion all the estate and interest of the above-named
defendant (comprising his estate in fee-simple in
possession, free from all encumbrances) in all that
piece or parcel of land containing by admeasurement
thirty acres, or thereabouts, situate in the County of
Geraldine, in the Provincial District of Canterbury,
New Zealand, and being the Rural Section numbered
4407 on the map or plan of the Chief Surveyor of
