THE NEW ZEALAND GAZETTE.

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, do hereby declare that the land
specified in the Schedule hereto shall be open for
sale, and that the twenty-fifth day of November next
ensuing shall be the day on which the said land shall
be open for sale.

Mulgrave of Mulgrave, all in the County
of York, in the Peerage of the United
Kingdom; and Baron Mulgrave of New
Ross, in the County of Wexford, in the
Peerage of Ireland; a Member of Her
Majesty's Most Honorable Privy Coun-
cil; Knight Grand Cross of the Most
Distinguished Order of Saint Michael and
Saint George; Governor and Commander-
in-Chief in and over Her Majesty's
Colony of New Zealand and its
Dependencies, and Vice-Admiral of the
same; and issued under the Seal of the
said Colony, at the Government House, at
Wellington, this fifteenth day of October,

ORDER IN COUNCIL.

At the Government House, at Wellington, this
fifteenth day of October, 1878.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

BY virtue of the powers and authorities vested in
me by the eleventh section of "The Public

tine, Marquis of Normanby, Governor of the Colony
of New Zealand, by and with the advice and consent
of the Executive Council of the said colony, do
hereby order and declare that the reserve made for
public recreation in the Provincial District of Otago,
and known as the "Dunedin Botanical Gardens,"
and described in the Schedule hereto, shall be and
the same is hereby brought under the operation of
and declared to be subject to the provisions of "The
Public Domains Act, 1860," and its amending Acts;
and such domain shall hereafter be managed, admin-
istered, and dealt with in manner directed by the
said Acts.

SCHEDULE.

ALL that area in the Provincial District of Otago,
containing by admeasurement forty (40) acres two
(2) roods and thirty-eight (38) poles, more or less,
being part of the Town Belt of the City of Dunedin.
Bounded towards the North-west by the Main North
Road, from the Water of Leith to the Opoho Road,
one thousand five hundred and thirty-five (1535)
links; towards the North-east by the said Opoho
Road, one thousand four hundred and ten (1410)
links; towards the East by the other part of said
Town Belt of the City of Dunedin, from the Opoho
Road to the Northern Cemetery Road, three thou-
sand four hundred links; towards the South-east by
the said Cemetery Road, two hundred (200) links;
towards the South by Sections numbered respectively
14 and 15, Block XXXVII., of the City of Dunedin,
and a road line, three hundred and fifty (350) links,
to the Water of Leith; and towards the West and
South-west by the Water of Leith, four thousand one
hundred and twenty-five (4125) links, to the starting
point: be all the aforesaid linkages more or less.

Also all that area in the Provincial District of
Otago, containing by admeasurement eight (8) acres
and two (2) roods, more or less, being part of the Town
Belt of the City of Dunedin. Bounded towards the
North-east by the Pine Hill Road and other part of
said Town Belt, two thousand two hundred and
thirty (2230) links; towards the South-east by the
Main North Road, seven hundred and fifty (750)
links; towards the South by the other part of the
said Town Belt, ninety-five (95) links, thence by the
Water of Leith, two thousand six hundred (2600)
links; towards the North-west by other part of said
Town Belt, being the back line of Sections numbered
respectively 26 and 27, Block XXXII., of the City of
Dunedin, produced, five hundred and eighty-five
(585) links: be all the aforesaid linkages more or
less.

Also all that area situated in the City of Dunedin,
containing by admeasurement two (2) acres three (3)
roods and eight (8) poles, more or less, being a por-
tion of the Town Belt of the City. Bounded towards
the North by North Boundary Road, two thousand
one hundred and fifty (2150) links; towards the
East by the Main North Road, four hundred and ten
(410) links; and towards the South and West by
the Pine Hill Road, two thousand and eighty (2080)
links: be all the aforesaid distances more or less.
