Defining the Middle Line of a portion of the Railway
from Napier to the junction with the Railway from
New Plymouth to Waitara at Sentry Hill, passing
by Pakipaki, Waipawa, Waipukurau, Takapau,
&c., &c., between 63 miles 30 chains and 70 miles.

A PROCLAMATION.

WHEREAS by the one hundred and twenty-
second section of "The Public Works Act,
1876," it is enacted that every railway shall be
only under the authority of a special Act, which
shall state as nearly as may be the line of the railway
and the two termini thereof; and by the one hundred
and twenty-third section of the same Act, that the
several railways specified in the Fourth Schedule to
the said Act shall be deemed to have been made, and
in so far as any of them are unfinished may be com-
pleted, under the provisions of the Act now under
recital, and the said Act shall be deemed to be a
special Act authorizing the construction of each of
the said railways; and by the one hundred and
twenty-fourth section of the same Act, that when any
railway is to be constructed under the provisions of
any special Act the Governor shall issue a Proclama-
tion defining the middle line of the railway or any
part thereof, and may from time to time, by a Pro-
clamation revoking or amending such former Pro-
clamation, alter such line in any manner or to any
extent which may be found necessary for the con-
struction of such railway within the provisions of
the said special Act; and by the one hundred and
twenty-fifth section of the same Act, that the
Minister shall cause to be made and deposited in the
office of the Registrar of the Supreme Court such
maps and plans as may be necessary to explain the
said line and the land through which the same passes,
and such maps and plans shall be referred to in any
such Proclamation; and whereas the railway from
Napier to the junction with the railway from New
Plymouth to Waitara at Sentry Hill, passing by Paki-
paki, Waipawa, Waipukurau, Takapau, &c., is one
of the railways specified in the said Fourth Schedule,
and the same is unfinished, and it has been deter-
mined to construct and maintain a further portion of
such railway:

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in exercise and in pursuance of the
powers and authorities conferred on me by "The
Public Works Act, 1876," and in exercise of every
other power and authority enabling me in that be-
half, do hereby proclaim and declare that the middle
line of the said further portion of such railway shall
be that defined and set forth in the Schedule hereto,
and that the two termini of the said line shall be a
point about sixty-three miles sixty chains on the rail-
way, as proclaimed on the eleventh day of August,
one thousand eight hundred and seventy-five, and a
point marked seventy miles near Reserves numbered
one hundred and seven and twenty-seven in the
Rakaiatai and Manawatu number seven Blocks,
within the County of Waipawa, Provincial Dis-
trict of Hawke's Bay, Colony of New Zealand. The
said middle line and the land through which the
same passes are set forth in the map and plan marked
P.W.D. 6023, and authenticated for the purposes of
this Proclamation by the signature of the Honorable
William James Mudie Larnach, Minister for Public
Works, and which said map and plan is deposited in
the office of the Registrar of the Supreme Court at
Napier, in the Provincial District of Hawke's Bay.


SCHEDULE.

COMMENCING at a point about 63 miles 60 chains (as
proclaimed on the 11th August, 1875), on the rail-
way from Napier to the junction with the railway
from New Plymouth to Waitara at Sentry Hill; pass-
ing by Pakipaki, Waipawa, Waipukurau, Takapau,
&c., and proceeding thence in a generally south-
westerly direction for a distance of 6 miles 20 chains,
and terminating at a point opposite to Reserves
Nos. 107 and 27 in the Rakaiatai and Manawatu No. 7
Blocks, passing in, through, and over the following
lands, viz.,-Native land, Manawatu No. 6, Tuatua,
Manawatu No. 7, and Raikaiatai Blocks, and all
adjoining and intervening lands, roads, reserves,
streams, rivers, and watercourses, all within the
County of Waipawa, Provincial District of Hawke's
Bay, and Colony of New Zealand; in the manner
delineated on the map and plan marked P.W.D.
