Lands in Township of Lumsden, Otago, open for sale to be known by the name of Lumsden, and it is
by public auction. expedient that a certain portion of the said township
should be opened for sale, as and in the manner
hereinafter mentioned:

A PROCLAMATION.
WHEREAS by "The Otago Reserves Act, 1874,"
it is, among other things, enacted that it shall
be lawful for the Superintendent of the said province,
on the recommendation of the Provincial Council of
the said province, by Proclamation to declare that
any such lands set aside under this Act as endow-
ments aforesaid shall be opened for sale or lease
under any provisions of "The Otago Waste Lands
Act, 1872," and any other Acts amending the same,
or for sale or lease under any provisions of "The
Gold Fields Act, 1866," and any other Acts amend-
ing the same; and from and after the time fixed for
the purpose in such Proclamation, such lands may
be sold or leased accordingly: And whereas by
"The Abolition of Provinces Act, 1875," it is also
enacted, that all powers, duties, and functions which
immediately before the date of the abolition there-
under of any province were under or by virtue of
any law not expressly or impliedly repealed or altered
thereby, vested in or to be exercised or performed by
the Superintendent of such abolished province, either
alone or with the advice and consent of or on the
recommendation of the Executive or Provincial
Council of such province, or which, by virtue of
"The Public Reserves Act, 1854," or any Act
amending the same, or by virtue of any Waste Lands
Act, or any regulations made thereunder or other-
wise howsoever, would, but for the said "Abolition
of Provinces Act, 1875," have been exercised only
under an Ordinance of such abolished province shall,
on the day of the date of the abolition of such pro-
vince, and for the purposes of the district included
within such abolished province, vest in and be
exercised and performed by the Governor: And
whereas under the provisions of the first-men-
tioned Act, Section 241, Hokonui District, has been
set aside as a Reserve for the endowment of edu-
cational institutions, as appears by an instrument
published in the Provincial Government Gazette of
the late Province of Otago, of the 16th day of June,
1875: And whereas certain part of the said land so
set aside as aforesaid, containing one hundred and
sixty-nine acres two roods and twenty-one perches
(169A. 2R. 21P.), more or less, has been surveyed and
laid out as a township, and is known or is intended
to be known by the name of Lumsden, and it is
expedient that a certain portion of the said township
should be opened for sale, as and in the manner
hereinafter mentioned:
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in pursuance and exercise of every
power and authority enabling me in this behalf, do
hereby proclaim and declare that the sections of
land in the said township of Lumsden identified by
the numbers mentioned in the Schedule hereto, shall
be opened for sale by public auction in accordance
with the provisions of "The Otago Waste Lands
Act, 1872," and of any Act amending the same,
relating to the sale of township lands. And in
further pursuance and exercise of the said power
and authority, I do hereby proclaim and declare that
the said sections shall be so opened for sale upon and
after the sixteenth day of May next.
