Imperial Mutiny Act, and Rules and Articles made
thereunder, received in New Zealand.

A PROCLAMATION.

WHEREAS by the forty-fourth section of "The
Militia Act, 1870," it is enacted that during
the time that any part of the Militia shall be on
actual service, all things contained in any Act of the
Imperial Parliament, which shall then be in force in
New Zealand, for punishing mutiny and desertion,
and for the better payment of the Army, and their
quarters, and in the Articles of War, made in pur-
suance of such Act, shall apply to, and the powers
thereby created shall be exercised by, such part of
the Militia in all cases not otherwise provided for in
"The Militia Act, 1870," or in any regulations that
may from time to time be issued under its authority:
Provided that no militiaman shall be liable to any
corporal punishment except death or imprisonment
for any offence against any such Act of the Imperial
Parliament or Articles: Provided also that no such
Act of the Imperial Parliament or Articles of War
shall be deemed to be in force in New Zealand until
a Proclamation shall have been published in the New
Zealand Gazette stating that the Governor has re-
ceived a copy thereof:

And whereas by the one hundred and second sec-
tion of the Act of the Imperial Parliament intituled
"An Act for Punishing Mutiny and Desertion, and
for the better Payment of the Army and their Quar-
ters," made and passed in the thirty-eighth year of
the reign of Her present Majesty Queen Victoria, it
is enacted that the same shall be and continue in
force in certain parts of Her Majesty's dominions at
and from such times as in the said section men-
tioned, and in all other parts of Her Majesty's
dominions, including New Zealand, from the first
day of February, one thousand eight hundred and
seventy-seven inclusive, until the first day of Feb-
ruary, one thousand eight hundred and seventy-eight:
Provided always that the same shall, from and after
the receipt and promulgation thereof in General
Orders in any part of Her Majesty's dominions or
elsewhere beyond the seas, become and be in full
force, anything therein stated to the contrary not-
withstanding:

And whereas New Zealand is not expressly men-
tioned in the said section of the said Act of the
Imperial Parliament:

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, Governor of the Colony of
New Zealand, by and with the advice and consent of
the Executive Council of New Zealand, and in pur-
suance of the requirements of "The Militia Act,
1870," aforesaid, and in exercise of the powers
thereby vested in me, do hereby proclaim and declare
that a copy of the said hereinbefore in part recited
Act of the Imperial Parliament, together with and
accompanied by a copy of "Rules and Articles for
the better Government of Her Majesty's Army,"
from the twenty-fifth day of April, one thousand
eight hundred and seventy-five, made and passed
under the authority of the said Act, has been received
by me in the colony aforesaid.

Given under the hand of His Excellency the
Most Honorable George Augustus Con-
stantine, Marquis of Normanby, Earl of
Mulgrave, Viscount Normanby, and Baron
Mulgrave of Mulgrave, all in the County
of York, in the Peerage of the United
Kingdom; and Baron Mulgrave of New
Ross, in the County of Wexford, in the
Peerage of Ireland; a Member of Her
Majesty's Most Honorable Privy Coun-
cil; Knight Commander of the Most
Distinguished Order of Saint Michael and
Saint George; Governor and Commander-
in-Chief in and over Her Majesty's Colony
of New Zealand and its Dependencies,
and Vice-Admiral of the same; and issued
under the Seal of the said Colony, at the
Government House, at Wellington, this
eighth day of March, in the year of our
Lord one thousand eight hundred and
seventy-seven.
