Notification that certain Crown Grants will contain reference to Conditions of Sale as to erection of Line of Telegraph.
Confiscated Lands Office,
Patea, 25th July, 1876.
WHEREAS certain sections of land in the Okutuku, Whenuakura, and Patea Blocks, West Coast (Confiscated) District, Provinces of Wellington and Taranaki, have been sold by Her Majesty subject to the conditions that, in the Crown grants to be issued to purchasers of those sections, a reservation to the effect set forth in the conditions hereto would be inserted:
It is hereby notified that, in lieu of an insertion at length of the conditions mentioned in the Schedule, each Crown grant will contain a reference to such condition, embodying the same.
SCHEDULE.
THE aforesaid sections of land were sold subject to the right of Her Majesty the Queen, or Her successors, or the Electric Telegraph Commissioner, or any person or persons acting under Her or his authority, from time to time and at all times, to enter upon the same sections, or any one of them, for the purpose of examining, repairing, and maintaining the line of telegraph now erected thereon, and the masts or posts supporting the said line of telegraph, or for the purpose of renewing, altering, or re-erecting the said line of telegraph and posts or masts as aforesaid, either on the same land or elsewhere, with full power for all or any of the purposes aforesaid to make any excavation in the said land, and to take and use so much of the soil as may be necessary for the purposes aforesaid.
All or any of the rights or powers mentioned in this condition may be exercised without obtaining any previous leave or consent from any purchaser or purchasers of the said sections to enter thereon as hereinbefore mentioned, nor shall such exercise of the said rights or powers entail any liability on the part of Her said Majesty, or the said Commissioner, or such person or persons as aforesaid, to make any compensation or allowance whatsoever to any such purchaser or purchasers.
Nothing in this condition shall prejudice any general rights or powers which may be given to or vested in Her said Majesty, or the said Commissioner, in respect of electric telegraphs in New Zealand, either by Statute or otherwise.
