Ohinemuri Licensing District Regulations.

NORMANBY, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this
third day of March, 1875.
Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the thirty-ninth section of "The
Licensing Act 1873 Amendment Act, 1874,"
it is, among other things, enacted that, in order to
make provision for the granting of licenses on gold
fields and in outlying districts, it shall be lawful for the
Governor from time to time to proclaim any district
in any province of the colony, the boundaries whereof
shall be defined in such Proclamation, to be a special
licensing district, and the boundaries of such district
from time to time to alter, and to abolish any such
district:

Provided that it shall be lawful for the Legislature
of any province in which any such districts may be
proclaimed to provide and declare what fees shall be
payable for any such license; to attach conditions to
the exercise and duration of any such license, and
to impose upon the licensee such duties, liabilities,
and obligations as shall be thought fit; and, subject
to the said Act, to prescribe the forms, time, and
mode of granting any such licenses:

Provided further that until any such Legislature
shall have passed any such Ordinance as aforesaid, it
shall be lawful for the Governor in Council to make
any regulations for all or any of the purposes for
which any such Ordinance may or can be passed under
or by virtue of the now reciting section, and all such
regulations shall be made with the consent of the
Superintendent of the province in which they are to
take effect, and shall be published in the New Zealand
Gazette, and in the Gazette of the province in which
they are so to take effect:

And whereas, by a Proclamation bearing even date
herewith, a special licensing district, to be called
"The Ohinemuri Special Licensing District," has been
constituted within the Province of Auckland:

And whereas the Legislature of the said province
has not passed any Ordinance for the purposes in the
hereinbefore recited section mentioned, and it is
expedient that regulations should be made for such
purposes:

Now, therefore, His Excellency the Governor, by
and with the advice and consent of the Executive
Council of the colony, in pursuance and exercise of
the power and authority vested in him in this behalf,
and with the consent of the Superintendent of the
said province, doth hereby make the following regu-
lations for the purposes aforesaid :β€”

REGULATIONS.

  1. Licenses may be issued for the sale of alcoholic
    liquors within the Special Licensing District of
    Ohinemuri upon payment of a fee not exceeding
    forty pounds nor less than twenty pounds.

  2. All such licenses shall be made to expire on the
    31st day of December next following the date of
    granting the same.

  3. The house and premises in respect of which any
    such license may be granted shall not be opened
    before six o'clock in the morning, and shall be closed
    at ten o'clock at night: provided that upon payment
    at the time of issue of license of an extra fee of five
    pounds, permission may be given to keep open the
    licensed premises until twelve o'clock p.m.; but
    the restrictions in this regulation contained shall not
    apply to the supply of refreshments to bona fide
    travellers.

  4. No such licensed house or premises shall be

opened for the sale of alcoholic liquors on Sundays,
except in the case of bond fide travellers as aforesaid.

  1. The accommodation to be provided in respect
    of any house or premises for which a license shall be
    applied for hereunder shall be such as shall be ap-
    proved of by the person empowered to grant such
    license.

  2. Applications for licenses must be in writing,
    addressed to the person empowered to grant the
    same, and must specify the locality for which the
    license is asked, and the accommodation provided or
    intended to be provided for the public, and the
    hours during which it is proposed such house and
    premises shall be open.

  3. Except in so far as they may be inconsistent
    with or contrary to the provisions of section 39 of
    "The Licensing Act 1873 Amendment Act, 1874," and
    of these regulations, the whole of the laws now in
    force within the Province of Auckland for the regu-
    lation of the sale of alcoholic liquors shall be
    applicable to all licenses granted hereunder; and
    excepting as aforesaid, any such licensee shall be
    deemed to have imposed upon him all the duties, lia-
    bilities, and obligations which are imposed upon the
    holders of publicans' licenses under the said laws.

  4. Every license granted hereunder shall be sub-
    ject to be forfeited, if in the opinion of the person
    empowered to grant licenses hereunder it shall be
    necessary or desirable to do so; and such forfeiture
    shall be deemed to be complete when notice thereof
    under his hand shall have been delivered to the
    licensee or affixed to the licensed premises.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
third day of March, 1875.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by "The Gold Fields Act, 1866," it
is enacted that it shall be lawful for the
Governor, by Order in Council, from time to time to
constitute for any gold field, or for any part thereof,
Wardens' Courts for the administration of justice
therein, and to appoint Wardens of such Courts,
with power to act alone or with assessors, and in
such manner, and to exercise all or any of the powers
thereinafter mentioned, as the Governor shall think
fit to direct:

And whereas by a certain Proclamation made by
the Honorable Daniel Pollen, dated the third day
of March, one thousand eight hundred and seventy-
five, and published in the Provincial Government
Gazette of the Province of Auckland on the third
day of the said month of March, the portion of the
colony in the said Province of Auckland therein
specified was constituted a gold field:

And whereas it is expedient that a Warden's Court
should be constituted in and for the said gold field:

Now therefore, His Excellency the Governor, in
pursuance and exercise of the said power and
authority, doth hereby, with the advice and consent
of the Executive Council of New Zealand, order that
a Warden's Court shall be and the same is hereby
constituted and established for the gold field con-
stituted by the hereinbefore recited Proclamation
dated the third day of March, one thousand eight
hundred and seventy-five, for the administration of
justice therein, and doth hereby appoint

WILLIAM FRASER, Esq.,
to be Warden of such Court, with power to act
