SECOND SCHEDULE.
TERMS AND CONDITIONS FOR THE OCCUPATION AND
PURCHASE OF THE BLOCK OF LAND PROPOSED TO
BE SET ASIDE FOR THE PURPOSE OF SPECIAL
SETTLEMENT.

In the construction of these terms and condi-
tions, unless the context shall otherwise require, the
following expressions shall have the meaning hereby
assigned to them:-" Association," shall mean the
said John Douglas and the persons associated or to
be associated with him for the purposes aforesaid.
"Land" shall mean the block of land described in
the First Schedule hereto. "Purchaser" shall mean
any one purchasing on behalf of the Association the
said land. "Receiver of Land Revenue" shall mean
the Receiver of Land Revenue at Wellington, or
other the officer for the time being acting as such.
"The said Act" shall mean "The Wellington Special
Settlements Act, 1871." -
All moneys required to be paid for the land
under these terms and conditions shall be paid to the
Receiver of Land Revenue, and receipts given by him
shall be sufficient discharges for the payment of the
moneys therein respectively acknowledged to have
been received. -
The price of the land shall be twelve shillings
and sixpence per acre, to be paid to the Receiver of
Land Revenue in cash, immediately after the publi-
cation of this Order in Council; and for the purpose
of such payment the area of the said land shall be
taken to be 21,800 acres. -
The external boundaries of the land shall be
surveyed at the cost of the Provincial Government of
Wellington, by a qualified surveyor, to be approved
by the Superintendent of the Province of Wellington,
without delay: And if on such survey the same
shall be found to contain a greater area than 21,800
acres, the Association shall pay to the Receiver of
Land Revenue, for every acre in excess of 21,800
acres, the price of twelve shillings and sixpence per
acre; but if the same shall be found to be less than
21,800 acres, the Superintendent of the Province of
Wellington shall pay to the Association, out of the
revenues of the said province, the sum of twelve
shillings and sixpence per acre for every acre less
than 21,800 acres the land shall be found to contain.
- The Association shall, immediately after the com-
pletion of the survey of the land, and upon produc-
tion to the Commissioner of Crown Lands for the
Province of Wellington, and satisfying the said Com-
missioner that the conditions hereafter contained
have been fulfilled, be entitled to a grant from the
Crown of the said land in fee-simple (except of the
block of seven thousand acres hereafter mentioned),
to the said John Douglas, his heirs and assigns, or to
him or them jointly, with any other person or persons
he or they may in writing require. And all usual
and accustomed fees payable for or in respect of the
issue of the said Crown grant shall be paid by the
Association.
(a.) That the Association will, within two years
and six months from the date of this Order
in Council, expend a sum of £10,000 at the
least upon the said land, and in draining and
otherwise improving the same.
(b.) That the Association will, for and during
the period of one year at the least from and
after the date of this Order in Council, employ
forty men at the least upon the said land, and
in draining and otherwise improving the same.
(c.) That the said Commissioner of Crown Lands
shall and may within six months from the
date of this Order in Council, select out of the
said land in one or more blocks seven thousand
acres, which in his judgment shall be suitable for
the settlement of and occupation by the settlers
hereinafter mentioned, which land so selected
is hereafter referred to as the "Selection
Blocks," and the said block shall be surveyed
and laid out by the Association in sections of
one hundred acres each.
(d.) That the Association will, before the 4th day
of September, 1876, place upon the selection
block at least seventy families of persons de-
sirous to settle on the said Selection Blocks, and
the terms and conditions upon which such per-
sons shall be entitled to settle on such Selection
Blocks shall be, that the head of each family
shall have the right, at any time within the
period of five years from the said 4th day of
September, 1876, to acquire by purchase one
hundred acres of the said Selection Blocks at a
price of two pounds per acre, to be paid to
the said Association by equal annual instal-
ments during the four years following the
selection by the settler of his land: Provided
that the person selecting may, at any time
within the said four years, pay up the balance
unpaid of the said sum of two pounds per acre.
(e.) Each head of such family shall be entitled
to a Crown grant of the land selected by him
upon proof to the satisfaction of the Commis-
sioner of Crown Lands that he has been con-
tinuously in the occupation of the land selected
by him, and has paid to the Association the
sum of two pounds per acre of the land
selected by him.
(f.) The said Commissioner of Crown Lands
shall also cause to be surveyed and laid off,
out of the said land to be conveyed to the
said Association, four hundred acres of land,
