THE NEW ZEALAND GAZETTE.

being in force relating to the sale of waste lands of
the Crown, or any law whatever, there is a right to
take a public road through any lands, it shall be law-
ful, after such road shall have been surveyed, to con-
struct under the said Acts any railway, or any part of
any railway, on the road so surveyed, notwithstanding
that such road may not have been made:
And whereas the Governor has determined to
construct and maintain a railway from Dunedin
to Moeraki, authorized to be constructed by "The
Railways Act, 1873," which said portion is herein-
after described:
Now therefore, I, the Right Honorable Sir James
Fergusson, Baronet, Governor of the Colony of New
Zealand, in exercise and pursuance of the powers
and authorities conferred on me by the hereinbefore
in part recited Acts, and in exercise of every other
power enabling me in this behalf, do hereby proclaim,
declare, and define the limits, description, and line
of the said portion of the said railway to be those
set forth in the First Schedule hereto; and that the
lands specified and described in the Second Schedule
hereto are proposed to be taken for the purposes of
the said portion of the said railway; and that the
limits of deviation shall be those set forth in the said
First Schedule hereto; and in pursuance and exercise
of all powers and authorities conferred on me in that
behalf, I do hereby fix the point of commencement of
the said portion of the said railway to be at or near a
point which is situated at or near the southern side of
High Street, in the City of Dunedin, in the Province
of Otago, the said point being about seven chains,
more or less, eastward from the Custom House in the
said City of Dunedin; and the point of termination
thereof to be at or near a point which is situated in
Section numbered 3 of 37, Block II., North Harbour
and Blueskin Survey District, in the same Province,
the said point being about twenty chains, more or
less, southward from the Waihema Stream.

FIRST SCHEDULE.
Description, Line, and Limits of Deviation of a
portion of the Railway from Dunedin to Moeraki,
in the Province of Otago.

COMMENCING at a point situated on the Railway
Station at or near the southern side of High Street,
in the City of Dunedin, about seven chains more or
less, eastward from the Custom House in the said
City of Dunedin, and passing in, through, over, or
into the following territorial divisions of the said
province, viz., City of Dunedin, North Harbour and
Blueskin Survey District, Upper Harbour West Sur-
vey District, Sawyer's Bay Survey District, Town of
Port Chalmers, Lower Harbour East Survey District,
Township of Blueskin, and terminating at a point in
Section numbered 3 of 37, Block II., North Harbour
and Blueskin Survey District, about twenty chains
southward from the Waihema Stream, as the limits,
description, and line thereof are set forth on the
plan in three sheets, and described in the book of
reference referred to on the face of the said plan,
and which plan and book are authenticated, for
the purposes of this Proclamation, by the signature
of the Honorable Edward Richardson, Minister for
Public Works, to be deposited in the office of the
Registrar of the Supreme Court at Dunedin, or
within the limits of deviation set forth in the said
plan by dotted red lines, being generally not more
than 110 yards on either side of the said line,
except where otherwise shown on plan, and passing
in, through, over, or into the several places, sections
of land, reserves, roads, streets, streams, watercourses,
harbours, and foreshores, enumerated in the Second
Schedule hereto.

SECOND SCHEDULE.
Lands proposed to be taken for the purposes of a
portion of the Dunedin and Moeraki Railway.
So much of the lands hereinafter mentioned as are
required for the said railway, along the line of the
said railway hereinbefore defined, or within the
limits of deviation aforesaid, as the lands are described
and defined in the plan and book of reference
aforesaid.

CITY OF DUNEDIN.
In Block 45, Railway Station. In Block 47, Sec-
tions 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 14, 15, 16, 17,
18, 19, 20, 21, and 22. In Block 52, Reserve,
Sections 2, 3, 4, 5, and 6. Reserve No. 3. In
Block 22, Sections 41, 42, 43, 44, 45, 46, and 47;
Wharves and Quays Reserves; foreshore of Otago
Harbour, Pelichet Bay; and all adjoining and
intervening places, lands, roads, streets, streams, and
watercourses.

NORTH HARBOUR AND BLUESKIN SURVEY DISTRICT.
In Block IX., Sections 52 and 53, foreshore of Otago
Harbour. In Block VI., Sections 38, 39, 40, 41, 42,
43, 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, 86, 87, 88,
89, 84, and 1 of 85. In Block IV., Sections 21, 52,
20, 22, 1 of 23, 2 of 23, 19, 18, 17, 16, 15, 47, 14, 13,
12, 11, and 10, Native Reserve, Government Reserve,
Sections 1 of 3, 2, and 1, foreshore of Purakanui
Bay, foreshore of Pacific Ocean. In Block I.,
Sections 1, 67, 2, 3, 2 of 4, 1 of 4, 1 of 5, 2 of 5, 6,
7, and 45, foreshore of Pacific Ocean, foreshore of
Blueskin Bay. In Block II., Sections 1 of 19, 2 of
