of road has been or hereafter may be reserved in any
Crown grant, and in any case in which, under "The
Native Lands Act, 1865," or any law for the time
being in force relating to the sale of waste lands of
the Crown, or any law whatever, there is a right to
take a public road through any lands, it shall be law-
ful, after such road shall have been surveyed, to con-
struct under the said Acts any railway, or any part of
any railway, on the road so surveyed, notwithstanding
that such road may not have been made:

And whereas the Governor has determined to
construct and maintain the Rakaia to Ashburton
Railway, including a bridge over the Ashburton
River, the same being a railway authorized to be
constructed by "The Railways Act, 1871," and
"The Railways Act, 1872:"

Now therefore, I, the Right Honorable Sir James
Fergusson, Baronet, Governor of the Colony of New
Zealand, in exercise and pursuance of the powers
and authorities conferred on me by the hereinbefore
in part recited Acts, and in exercise of every other
power enabling me in this behalf, do hereby proclaim,
declare, and define the limits, description, and line
of the said railway to be those set forth in the First
Schedule hereto; and that the lands specified and
described in the Second Schedule hereto are proposed
to be taken for the purposes of the said railway;
and that the limits of deviation shall be those set
forth in the said First Schedule hereto; and in pur-
suance and exercise of all powers and authorities
conferred on me in that behalf, I do hereby fix the
point of commencement of the said railway to be
on the northern bank of the River Rakaia, at or
near the northern end of the Rakaia Bridge of the
Great Southern Railway, in the Province of Canter-
bury; and the point of termination thereof to be at
or near the north-eastern corner of Rural Section
numbered 3936, in the Province of Canterbury afore-
said.

FIRST SCHEDULE.
Limits, Description, Line, and Limits of Deviation of
the Railway from Rakaia to Ashburton, including
Bridge over the Ashburton, in the Province of Can-
terbury.

COMMENCING on the northern bank of the River
Rakaia, at a point at or near the northern end of the
Rakaia Bridge of the Great Southern Railway, and
passing in, through, and into the following road
districts, viz.: -The Rakaia Road District, the Ash-
burton Road District, and terminating at or near
the north-eastern corner of Rural Section numbered
3936, in the Province of Canterbury aforesaid, as
the limits, description, and line thereof are set forth
in the plan, and described in the book of reference
referred to on the face of the said plan, and which
plan and book are authenticated for the purposes of
this Proclamation by the signature of the Honorable
Edward Richardson, Minister for Public Works, to
be deposited in the office of the Registrar of the
Supreme Court at Christchurch, or within the limits
of deviation set forth on the said plan by dotted red
lines, being not more than 110 yards on either side
of the said line, and passing through or over the
several sections of land, roads, reserves, rivers, and
watercourses enumerated in the Second Schedule
hereto.

SECOND SCHEDULE,
OR BOOK OF REFERENCE.
Lands and Roads, &c., proposed to be taken for the
purposes of the Rakaia and Ashburton Railway.
So much of the lands and roads hereinafter mentioned
as are required for the said railway along the line of
the said railway hereinbefore defined, or within the

limits of deviation aforesaid, as the lands are de-
scribed and defined in the plan or book of reference
aforesaid.

RAKAIA ROAD DISTRICT.
The River Rakaia.

ASHBURTON ROAD DISTRICT.
The River Rakaia, the Railway Reserve, Rural
Section numbered 6129, Town Reserve numbered
174, Rural Sections numbered 5732, 16196, 16220,
16221, 16222, 16223, Reserve numbered 1466, Rural
Sections numbered 16331, 16124, 16213, Reserves
numbered 1497, 264, 1496, 1313, 1035, 1261, Rural
Sections numbered 4109, 5800, 4906, the Township
of Ashburton, Rural Section numbered 3936, and all
intervening roads, streams, and watercourses.

Given under the hand of His Excellency the
Right Honorable Sir James Fergusson,
Baronet, a Member of Her Majesty's Most
Honorable Privy Council, Governor and
Commander-in-Chief in and over Her
Majesty's Colony of New Zealand and its
Dependencies, and Vice-Admiral of the
same; and issued under the Seal of the
said Colony, at Wellington, this twentieth
day of August, in the year of our Lord
one thousand eight hundred and seventy-
three.

Operation of Native Lands Acts suspended in certain
Districts.

A PROCLAMATION.

WHEREAS by the fourth clause of "The Native
Lands Act, 1867," it is made lawful for the
Governor of New Zealand, by Proclamation, to define
districts within which the operation of "The Native
Lands Act, 1865," and "The Native Lands Act,
1867," or any of the provisions thereof, shall be
suspended:

Now therefore, I, the Right Honorable Sir James
Fergusson, Baronet, Governor of New Zealand, do
hereby proclaim and declare that the provisions of
the above-mentioned Acts shall be suspended, and
are suspended, within the district described in the
Schedule hereto appended.

Given under the hand of His Excellency the
Right Honorable Sir James Fergusson,
Baronet, a Member of Her Majesty's
Most Honorable Privy Council, Governor
and Commander-in-Chief in and over Her
Majesty's Colony of New Zealand and its
Dependencies, and Vice-Admiral of the
same; and issued under the Seal of the

ALL that piece or parcel of land in the Bay of Plenty
and Taupo Districts, Province of Auckland, within
the following boundaries: -Commencing at the sum-
mit of Otanewainuku Hill, to the summit of Otara;
thence by a straight line to the mouth of the Wai-
rakei Creek on the coast. On the East, by the sea to
the mouth of the Waitahanui River; from thence in a
line to the summit of Putauaki (Mount Edgecumbe);
thence to meridian line 177° longitude; thence South,
on the said meridian, to 39th parallel of latitude;
