calendar month after such notice to comply there-
with, then the Minister may cause the assent to the
application for a loan in respect of such enterprise to
be cancelled, and any moneys advanced under the
same to be recovered under the security to be granted:
Provided that the Minister may, if he think fit, agree
during the progress of any works to such modifica-
tions as he may approve.

  1. The promoters of any undertaking may at any
    time remove the same from the operation of these
    Regulations, by writing under their hands, or under
    the hands of their registered manager, addressed to
    the Minister, and on repayment of the moneys that
    may have been advanced by the Government, with
    interest to date.

  2. A full and correct account of the cost of con-
    struction of any undertaking to which the benefits of
    the Act are extended shall be kept at the office of
    the promoters, and shall be open at all reasonable
    hours to the inspection of any person deputed by the
    Minister, and a statement of all payments on such
    accounts shall be forwarded at such periods and
    intervals as the promoters and the Minister may
    agree upon. A final account, showing the cost of the
    works, shall on their completion be forwarded through
    the District Engineer to the Minister, and the final
    balance shall be paid on this account in the propor-
    tion above stated. Always provided that the pro-
    posed manner of carrying out the work, either by
    contract or otherwise, shall have been previously
    approved of by the Minister.

  3. The promoters of any undertaking to which
    money may be advanced shall, before the issue of
    any loan to them, give to the Minister a valid
    security, including a lien or mortgage to cover the
    amount of loan over the works and property proposed
    to be constructed; and all deeds necessary shall be
    prepared and completed at the expense of the pro-
    moters.

  4. No money shall be paid toward the construc-
    tion of any water race, dam, or reservoir until the
    promoters of the same shall have duly registered
    themselves under the Mining Companies Act or the
    Joint Stock Companies Act.

  5. The rate of interest to be paid by the pro-
    moters of any undertaking coming under these
    Regulations shall be seven pounds per centum per
    annum, payable quarterly from the date of the ad-
    vance into the Public Account at the nearest branch
    of the Bank of New Zealand.

  6. The capital sum borrowed shall be repaid out
    of the profits of the undertaking in the same pro-
    portion as the amount of money advanced by the
    Government bears to the paid-up capital of the
    Company, or in such other proportion as the Minister
    may determine.

  7. In the foregoing, the term "Minister" shall
    mean the Minister for Public Works or the Minister
    acting for him for the time being; and the terms
    "Engineer-in-Chief," "Assistant Engineer-in-Chief,"
    and "District Engineer," shall mean the officers
    appointed under those designations by the said
    Minister.

Application for Registration of Trade Mark.

IT is hereby notified, that Edward Bennett, of
Shortland Street, Auckland, in the Colony of
New Zealand, Solicitor, by his Agents, Messieurs
Hart and Buckley, of the City and Province of

| Wellington, in the Colony aforesaid, Solicitors, for
and on behalf of DAVID H. BURKE, as the Executor
of UDOLPHO WOLFE, of Beaver Street, New York,
in the United States of America, have, in pursuance
of "The Trade Marks Act, 1866," applied to register
a Trade Mark of a Tonic Antidyspeptic Invigorating
Cordial, or Schnapps, in the name of the said
Edward Bennett, of the following description :-

The bottles containing the Schnapps are square,
with the words "Udolpho Wolfe's on the side;
the word "Schiedam" on another side; and the
words "Aromatic Schnapps" on the third side, all in
raised Roman capital letters. On the fourth side is
a label, with the words and figures following:

"Wolfe's Schiedam Aromatic Schnapps having
become so numerous in the United States, the pro-
prietor deems it necessary to caution the public
against those vile impostors. Some imitate his label,
while others use his autograph signature. Hereafter
the genuine Schnapps will bear the autograph
signature of David H. Burke, attached to this label.
Udolpho Wolfe, 18 and 22 Beaver Street, New
York. I hereby certify that the liquor contained in
this bottle is the genuine Wolfe's Schiedam Aromatic
Schnapps. David H. Burke, 22, Beaver Street, New
York"-all in blue ink.

And which Trade Mark it is intended by the said
Edward Bennett, as Agent for the said David H.
Burke, who is the Executor of the said Udolpho
Wolfe, to apply to Schnapps of his own manufacture,
in bottles.

Notice is hereby given, that unless it be shown to
my satisfaction, before the expiration of sixty days
from the publication hereof, that such Trade Mark
has been previously registered, or that some other
person is entitled to such Trade Mark, or that such
Trade Mark is so like some other Trade Mark that
it may be mistaken for the same, a certificate will, in
pursuance of the provisions of the said Act, be
issued to the said Edward Bennett, as Agent for the
said David H. Burke as Executor of Udolpho Wolfe,
certifying that he is entitled to the use of the same.

1867:" Notice is hereby given, that a transcript
of the By-laws of
The Court of Coromandel, 5260, A.O.F.,
duly certified, has been lodged with the Registrar of
Friendly Societies, registered and recorded under the
provisions of "The Friendly Societies Act, 1867."
