ORDER IN COUNCIL.

At the Government House, at Auckland, this
third day of November, 1870.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHER EAS by " "The Payments to Provinces Act,
1870," it is enacted that in each year during
the seven years ending on the thirtieth day of June,
one thousand eight hundred and seventy-seven,
there shall be paid out of the Consolidated Revenue
of the Colony the sum of fifty thousand pounds,
which shall be divided among and paid to the several
Provinces and the County of Westland in proportion
to their respective populations, and that all sums so
paid shall be paid into the Bank at which the Pro-
vincial Account or the County of Westland Account,
as the case may be, is for the time being kept, and
shall there be placed to the credit of a special
account, to be called "The Road District Funds
Account" of the Province or County: And whereas
by the said Act it is further enacted that the said
moneys shall be available only for division among the
Road Boards of the Province or County in accord-
ance with a scheme to be proposed, for each year,
by the Superintendent or Deputy Superintendent of
the Province, or the Chairman of the County Council
of the County, for his Province or County, and
approved by the Governor in Council, for the first
year, and by Resolution of both Houses of the
General Assembly for the remaining years; and
further, that the Governor in Council may amend
any proposed scheme before approving of it, and the
scheme when amended and approved shall have the
same force and effect as if originally proposed and
approved in its amended form:

And whereas there is available for division amongst
the Road Boards of the Province of Otago for the
year ending the thirtieth June, one thousand eight
hundred and seventy-one, the sum of fourteen
thousand pounds: And whereas the Superintendent

of the Province of Otago has proposed a scheme for
the division of the said sum, and such scheme has
been amended and then approved by the Governor
in Council:

Now it is hereby ordered that the said sum of
fourteen thousand pounds shall be divided amongst
the Road Boards of the Province of Otago in the
same proportion as any sum appropriated by an Act
or Ordinance of the Superintendent and Provincial
Council of the Province of Otago, for division
amongst the Road Boards of the said Province shall
be divided.

IT is hereby notified that William Wood, Esq., the
person duly appointed to preside at the taking
of the ballot at the election of seven persons who,
together with the Superintendent of the late Province
of Southland, were to represent in the Provincial
Council of the United Province of Otago that
portion thereof formerly included in the late Pro-
vince of Southland, has certified to His Excellency
the Governor that the persons whose names are as
follows were declared duly elected to be Members
of the Provincial Council of Otago; that is to sayβ€”
