ORDER IN COUNCIL.
At the Government Offices, at Wellington, this
nineteenth day of October, 1870.
Present :
THE HONORABLE DONALD MCLEAN, NATIVE AND
DEFENCE MINISTER, PRESIDING, AND MEMBERS
OF THE EXECUTIVE COUNCIL.
WHEREAS by the sixty-seventh section of "The
Regulation of Elections Act, 1870," it is
enacted that no election shall be void in consequence
only of there having been no Returning Officer at
the time of the issue of the writ or of any delay in
the return of the writ, and where any accidental or
unavoidable impediment, misfeasance, or omission
shall have happened, the Governor in Council may
take all such measures as may be necessary for re-
moving such impediment or rectifying such mis-
feasance or omission, or may declare any or all of
the proceedings at or for any election valid as to
and notwithstanding such impediment, misfeasance,
or omission, and every such Order in Council shall
state specifically the nature of the impediment, mis-
feasance, or omission, and shall be forthwith published
in the New Zealand Gazette: And whereas a writ
for the election of a Member of the Provincial
Council of Southland was issued on or about the
twentieth day of September last, purporting to be
issued under "The Provincial Elections Act, 1858,"
instead of under "The Regulation of Elections Act,
1870:" And whereas the Returning Officer for the
District gave less than seven days' notice of the day
and hour on which the nomination, and of the day on
which the polling, for such election would take place,
contrary to the provisions of the said Act: And
whereas the Returning Officer for the said District
in and for which the said election was to be held
appointed the thirtieth day of September last to be
the nomination day, and the first day of October,
one thousand eight hundred and seventy, to be the
polling day for the said election: And whereas the
said days were appointed without due notice, and
were otherwise irregular and contrary to the pro-
visions of the said Act: And whereas the form of
stamp used for the purposes of the forty-third section
of the said Act in the said election was similar to the
Post Office Stamp used on the first day of October,
one thousand eight hundred and seventy, and had not
been determined or authorized by the Governor in
Council or provided by the said Act: And whereas
one Samuel Hodgkinson was declared by the Re-
turning Officer at the said election to be duly elected
thereat: And whereas it is expedient to declare the
said election valid, notwithstanding the said irregu-
larities, misfeasances, and omissions:
Now therefore, His Excellency the Governor, in
exercise and pursuance of all powers and authorities
enabling him in this behalf, and with the advice and
consent of the Executive Council of New Zealand,
doth hereby declare all the proceedings at and for
the said election valid as to and notwithstanding the
hereinbefore recited impediments, misfeasances, and
omissions.

SECTION IV.
Honorary Members.
Whereas the rules of the Societies incorporated
under the New Zealand Act provide for the election
of honorary members of such Societies; but inasmuch
as such honorary members would not thereby become
members of the New Zealand Institute, and whereas
it is expedient to make provision for the election of
honorary members of the New Zealand Institute, it
is hereby declared :β
1st. Each incorporated Society may, in the month
of November next, nominate for election as honorary
member of the New Zealand Institute, three persons,
and in the month of November in each succeeding
year one person, not residing in the Colony.
2nd. The names, descriptions, and addresses of
persons so nominated, together with the grounds on
which their election as honorary members is recom-
mended, shall be forthwith forwarded to the Manager
of the New Zealand Institute, and shall by him be
submitted to the Governor at the next succeeding
meeting.
3rd. From the persons so nominated the Governor
may select, in the first year, not more than nine,
and in each succeeding year not more than three,
who shall from thenceforth be honorary members of
the New Zealand Institute, provided that the total
number of honorary members shall not exceed thirty.
