one thousand eight hundred and sixty-eight, the
Bay of Islands District and the Waimate District
were respectively constituted and defined under the
said Act, and it is expedient to alter the boundaries
of the said districts:

Now, therefore, His Excellency the Governor, in
pursuance and exercise of the power and authority
in him vested for this purpose, doth hereby, with the
advice and consent of the Executive Council of the
Colony, constitute and define the districts following
to be districts within and for which Courts of Petty
Sessions shall be held for the purposes of the said
Act; that is to say--

PROVINCE OF AUCKLAND.

Bay of Islands District.

This district is bounded on the North by the sea
(including adjacent islands) from the north-western
angle of the Whiroa Block to Cape Brett; on the
East, by the sea from Cape Brett aforesaid to the
south-eastern termination of the northern boundary
of the County of Marsden; on the South, by the
northern boundary of the County of Marsden afore-
said; and on the West, by the eastern boundary of the
Waimate District to the intersection of same by the
Waiomio River, thence by western boundaries of the
Ruapekapeka and Kawakawa Blocks to the northern
angle of the said Kawakawa Block, and thence by a
straight line drawn to the commencing point at the
sea on the north-western corner of Whiroa Block.

Waimate District.

As much of the Bay of Islands Electoral District
as is not comprised within the Bay of Islands Petty
Sessions District.

ORDER IN COUNCIL.

At the Government House at Wellington, this
twenty-seventh day of January, 1869.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by "The Gold Fields Act, 1866," it
is enacted that it shall be lawful for the Go-
vernor in Council, from time to time to make, alter,
and revoke rules regulating the procedure and prac-
tice in the Courts to be established under the said
Act: And whereas, by an Order in Council dated the
seventh day of March, one thousand eight hundred
and sixty-eight, and published in the New Zealand
Gazette on the ninth day of March in the year afore-
said, certain Rules regulating the Practice and Pro-
cedure of Wardens' Courts established under the
said Act were made, and amongst other things it was
by the ninth of the said Rules provided as follows:-

"The parties in every complaint, action, and pro-
ceeding, shall appear and act personally or by a
barrister or solicitor of the Supreme Court, or, in the
absence of any barrister or solicitor, and by leave
of the Warden, by an agent to be appointed by the
plaintiff or defendant in writing." And whereas it
is expedient that further provision should be made
with respect to the manner in which parties may
appear in Wardens' Courts:

Now, therefore, His Excellency Sir George Fergu-
son Bowen, Governor of New Zealand, in exercise
and pursuance of the power and authority conferred
on him by the said Act, and by and with the advice
and consent of the Executive Council of New Zealand,
doth hereby order that the Rule set forth in the
Schedule hereto shall be a Rule regulating the
Practice and Procedure of all Wardens' Courts
established or to be established under the said Act,
and shall be taken and read as a proviso to the ninth
of the said Rules published in the said Gazette on
the ninth day of March last.

SCHEDULE.

Provided that the Warden of any Warden's Court
may, on being satisfied that any person is a fit and
proper person to be registered as an Agent to act in
such Court on behalf of parties in any such com-
plaint, action, or proceeding, register such person as
an Agent to appear and act at that Court for any
such parties; and any person so registered may, so
long as his name shall be on the Register kept at
such Court, have the right, in the absence of a
barrister or solicitor, to appear and act for any
party without express or further permission from
the Warden of the Court; but such registration may
be cancelled at any time by the Warden acting at
such Court on it being made to appear to him that
such person has been guilty of misconduct, or is
otherwise unfit to act for parties in such Court.

WHEREAS by the one hundred and thirty-third
section of an Act of the General Assembly of
New Zealand, intituled "The Municipal Corporations
Act, 1867," it is enacted that it shall be the duty of
the Town Clerk of every borough, as soon as con-
veniently may be after every election of a Mayor for
such borough, to give notice to the Colonial Secretary
for the time being of such election, and of the person
elected; and it shall be lawful for the Governor, if he
shall think fit, and if such person shall not then be a
Justice of the Peace, by warrant under his hand
published in the New Zealand Gazette, to appoint
such person to be a Justice of the Peace for the
Colony; and it is also thereby enacted that in every
such appointment it shall be expressed that it is made
under the one hundred and thirty-third section of
the said Act; and it is further declared that such
appointment shall continue in force only during
the Mayoralty of such person, and the person so
appointed shall not, by virtue of such appointment,
be authorized to sit or act as a Justice of the Peace
elsewhere than within the borough:

Now therefore I, Sir George Ferguson Bowen,
the Governor of the Colony of New Zealand, in pur-
suance and exercise of the said power and authority
in me vested in this behalf, do hereby appoint

EDWARD MASTERS Esq.,

the person elected to be Mayor of the Borough of
Greymouth, to be a Justice of the Peace under the
one hundred and thirty-third section of "The Muni-
cipal Corporations Act, 1867."

Given under the hand of His Excellency Sir
George Ferguson Bowen, Knight Grand
Cross of the Most Distinguished Order
of Saint Michael and Saint George,
Governor and Commander-in-Chief in
and over Her Majesty's Colony of
New Zealand and its Dependencies, and
Vice-Admiral of the same, at the Govern-
ment House at Wellington, the twenty-
third day of January, in the year of our
Lord one thousand eight hundred and
sixty-nine.
