THE following Report by the Accountant in Bank-
ruptcy is published in pursuance of "The Bank-
ruptcy Act, 1867."
E. W. STAFFORD.
To their Honors,
The CHIEF JUSTICE and the JUDGES of the
Supreme Court of New Zealand.
THE Accountant in Bankruptcy begs respectfully
to lay before the Court his first Annual Report
applicable to the year ending 30th November, 1868,
which has been framed after the plan adopted by the
Accountant in Bankruptcy in Scotland.
The following notes are submitted as containing
general results, which have been deduced from the
information before the Accountant in Bankruptcy.
The Accountant regrets that the information in his
possession is not so complete as he could have wished,
and consequently his Report is in some parts im-
perfect. The Accountant hopes, however, when
trustees and the officers of the Supreme and District
Courts have become better acquainted with their
duties, under Part XV. of the Act of 1867, that
clearer and more accurate information will be
supplied to him, so that his next Annual Report may
be complete in all its details.
Some trustees appointed under the Act have also
shown considerable remissness in complying with the
provisions of Section 226; but as this was the first
Return required from them under the Act, the
Accountant did not deem it necessary to bring their
conduct under the notice of your honorable Court.
The Accountant thinks it right to add that in all
cases where the provisional trustee has become sole
trustee, he has not experienced any difficulty in
obtaining the information required to be furnished to
him in accordance with the provisions of Part XV.
The results are reported in the following order:—
I.
The number of orders of adjudication made
during the year ending 30th November,
1868, has been ... ... ... 294
Whereof there have been made by the
Supreme Court ... ... ... 193
And by the District Court ... ... 101
So that during the year 65.65 per cent., or there-
abouts, have been made by the Supreme Court, and
34:35 per cent., or thereabouts, by the District
Courts.
The following is a note of the adjudications made
during the year, classified according to the Provinces
and Districts to which they are applicable:—
| Adjudged by the Supreme Court. | Adjudged by the District Court. | Total. | |
