Public Account as revenue, either by the completion
of the action necessary in respect of such moneys, or
by their having become forfeit to the Crown.
4. Every Receiver of Public Money, on the day
on which he is appointed to account (and if such
day be a holiday, then on the day previous,) shall,
before the Bank closes on that day, pay in the whole
amount of his collections up to that time; and shall,
at the close of business on the same day, prepare his
statement or account, and shall include therein all
sums of money received by him (if any) subsequent
to the payment of his collections into the Bank as
above stated; and shall, before noon on the following
day, forward such statement or account to the
Sub-Treasurer of his Province or District, together
with the balance of his collections for the period
therein included, obtaining a receipt for the same in
the Form B.

ORDER IN COUNCIL.

At the Government House, at Wellington, the
twelfth day of January, 1867.

WHEREAS by an Act of the General Assembly
of New Zealand, intituled "The Marine Act,
1866," it is amongst other things enacted, that it
shall be lawful for the Governor in Council from time
to time to make such regulations as may be found
necessary respecting the anchoring and mooring of
vessels in any port, the packing, landing, deposit,
and removal of gunpowder, the erection of magazines
for the safe keeping thereof, the watering and
ballasting and discharging of ballast of or from
vessels, and all other matters relating to the safe and
commodious navigation of any port, harbour, or
river, or the entrance thereto, and the order and
management of vessels resorting thereto; and for the
purpose of giving effect to such regulations to impose
any penalty not exceeding twenty pounds for any
one offence against any provisions of such regulations:
Now therefore, I, the Governor, with the advice
and consent of the Executive Council, do hereby
make the following regulations, that is to say,-

That the flag to be carried by any vessel from
other than New Zealand ports when entering
any port in New Zealand, until boarded and
cleared by the Health Officer, shall be No. 8
of Marryatt's Code of Signals at the main.
That the flag to be carried by any vessel in any
port in New Zealand which has gunpowder
on board in excess of the usual ships' stores
until such gunpowder be landed or tran-
shipped, shall be a red flag at the main.
That the flag to be carried by any vessel
employed in carrying Her Majesty's Mails,
when entering any port in New Zealand,
shall be Marryatt's telegraph flag at the main.
And I do further declare that the master of any
vessel failing to comply with these regulations, shall
be liable to a fine not exceeding ten pounds for each
and every offence. And I do further declare that all
existing regulations inconsistent herewith are hereby
revoked.
This Order in Council shall take effect from and
after the first day of March, one thousand eight
hundred and sixty-seven.

SALE.
Auckland, 31st December, 1866.

UNDER and in pursuance of the powers vested in me
as the Commissioner appointed by His Excellency
the Governor to carry out the regulations for the
sale of lands taken for settlement under "The New
Zealand Settlements Act, 1863," in the Province of
Auckland, I, Frederick Whitaker, do hereby notify
that the lands specified in the Schedule hereunder
written, will be open for selection and sale as General
Rural Land, in accordance with the said regulations,
at the Waste Lands Office, at Auckland, at noon, on
Tuesday, the 12th day of March, 1867.

The lands open for selection at a fixed price under
the above notice are divided into three classes
according to relative value, viz. :-
43,000 acres of 1st class at 15s. per acre.
216,000 acres of 2nd ,, 10s. ,,
324,000 acres (inclusive of 153,000 acres of
swamps) of 3rd class, at 5s. per acre.
Application may be made in writing at any time
before Tuesday the 12th March, 1867.
All applications made prior to the 12th March,
1867, will be treated as made at the same time, and
will be opened at twelve o'clock at noon on that day
