ORDER IN COUNCIL.
At the Government House, at Wellington, the
twenty-sixth day of October, 1867.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by an Act of the General Assembly
entitled "The Gold Fields Act Amendment
Act, 1867," it is enacted that whenever the Governor
shall have delegated to the Executive Government
of any Province as herein provided all or any of the
powers vested in the Governor or in the Governor in
Council by "The Gold Fields Act, 1866," it shall be
lawful for the Governor, by Order in Council, to
appoint and declare that all the costs, charges, and
expenses incident to the management and adminis-
tration of the gold fields within such Province shall
be regulated by Acts or Ordinances to be passed by
the Superintendent and Provincial Council of such
Province; provided that the revenues and receipts
arising from fees, fines, rents, penalties, or in any
other manner under "The Gold Fields Act, 1866,"
or any Act for the time being in force for the
management of the gold fields, shall be charged in the
first instance with the salaries and remuneration of
all judicial officers and courts as shall be fixed or
appointed by the Governor from time to time.
And whereas by an instrument in writing bearing
date the twenty-sixth day of October, issued under
the public seal of the Colony, the Governor, with the
advice and consent of the Executive Council of the
Colony, and in exercise of the powers vested in him,
hath delegated to the Executive Government of the
Province of Otago all such powers vested in the
Governor or in the Governor in Council by "The
Gold Fields Act, 1866," as under the one hundred
and ninth section of the said last-mentioned Act may
be delegated by the Governor in Council:
Now therefore, His Excellency the Governor, in
pursuance and exercise of the power and authority
for this purpose vested in him, doth hereby, with the
advice and consent of the Executive Council of the
Colony, appoint and declare, subject to the provisions
of "The Otago Gold Fields Judicial Officers Act,
1867," that, from and after the first day of Novem-
ber next, all the costs, charges, and expenses
incident to the management and administration of
the Gold Fields within the Province of Otago shall
be regulated by Acts or Ordinances to be passed by
the Superintendent and Provincial Council of such
Province.
