liabilities, and engagements specified herein,-this
Court expressly reserving to the said petitioner the
receiver, the said trustee, and the said creditors
liberty to apply to the Court as they may see fit or
be advised.

IN the Supreme Court of New Zealand: Otago and
Southland District.

In the matter of the petition of Lewis Miller, of
Arrow Flat, in the Province of Otago, cattle
dealer, a bankrupt, and David Clark, of the
Kawarau, in the Province of Otago aforesaid,
contractor, a creditor of the said Lewis Miller to
the extent of not less than Fifty pounds; and
in the matter of "The Debtors and Creditors Act,
1862," "The Debtors and Creditors Act Amend-
ment Act, 1865," and "The Debtors and Creditors
Acts Amendment Act, 1866."
Before His Honor Mr. Justice Chapman.

UPON reading the petition of the abovenamed bank-
rupt and David Clark, and the affidavit thereto
annexed, and upon hearing the solictor for the said
bankrupt, I do order that a meeting of the creditors
of the said bankrupt be held at the office of George
Brodie, Esq., the Inspector in Bankruptcy, at the
Custom House, Dunedin, in the Province of Otago
aforesaid, on Saturday, the twelfth day of October,
instant, at ten o'clock in the forenoon, for the
purpose of investigating the affairs of the said
bankrupt, and for recommending to this Court a fit
and proper person to be appointed a co-trustee with
the said George Brodie, of the estate and effects of
the said bankrupt; and I do further order, that
failing such meeting and recommendation of a
trustee as aforesaid, the real and personal estate of
the said bankrupt, Lewis Miller, mentioned and set
out in the schedule annexed to the said petition, be
placed under sequestration in the hands of the said
George Brodie alone, to be taken and held by him,
his heirs, executors, and administrators, respectively,
(except the wearing apparel of the bankrupt, his
wife and children, which shall be retained by them),
upon and for the following trusts and purposes,
namely:

  1. To sell collect and get in such real and personal
    estate, and to receive the moneys to arise therefrom,
    and execute all necessary conveyances and assurances
    thereof.
  2. To retain and pay all expenses properly
    incurred of and attending such sale, collection, and
    getting in.
  3. To pay the poundage and all other fees payable
    under the above-mentioned Acts.
  4. To pay the costs properly incurred of and
    incidental to the petition in these matters, and
    subsequent thereto, such costs to be first taxed; and
    also all costs and expenses in these matters which
    have been or shall be ordered by this Court, or by
    any Judge thereof, to be paid out of the estate of the
    bankrupt.
  5. To distribute the net residue of the said trust
    moneys between and amongst and for the benefit of
    all the creditors of the bankrupt who were his
    creditors at the time of the presentation of his
    petition, and who shall duly prove their debts by
    affidavit filed in the office of the Registrar of this
    honorable Court within three calendar months from
    the date of this order, by way of pro rata distribution,
    subject to existing legal priorities (if any), but so
    that the creditors shall not receive more than twenty
    shillings in the pound upon their said respective
    debts.
  6. To pay the ultimate surplus (if any) of the
    said trust moneys to the said bankrupt.
    And I direct that in the event of the said estate
    and effects of the said bankrupt becoming so vested in
    the said George Brodie as such trustee as aforesaid,
    this order shall operate and take effect as if the said
    estate and effects had been placed under sequestration
    in the hands of the said George Brodie on the date
    hereof; and I declare that this order shall be a
    vesting order; and I also order that the further
    hearing of the petition of the said bankrupt be and
    the same is hereby adjourned until the eleventh day
    of November next.
    Dated at Dunedin this fourth day of October, one
    thousand eight hundred and sixty-seven.

In the matter of "The Joint Stock Companies Act,
1860," and in the matter of the Dunedin Steam
Shipping Company (Limited), and in the matter
of the petition of Alexander Carrick, of Dunedin,
merchant, a contributory to the abovenamed
Company.

UPON reading the humble petition of Alexander
Carrick, of Dunedin, merchant, and it appearing
from the said petition and the affidavit in verification
thereof that the Company is unable to pay its debts,
and that three-fourths of the capital of the Company
have been lost, and for the other reasons appearing in
the said petition: It is ordered that the said Dunedin
Steam Shipping Company (Limited) be wound up
by the Court under the provisions of part three of
the said "Joint Stock Companies Act, 1860." It
is further ordered that William Oram Ball, of Princes
Street, Dunedin, be and he is hereby appointed
the Official Liquidator of the said Company until the
further order of this Court, upon his first giving
security to the satisfaction of the Registrar of the
Court for the due performance of his duties as such
Official Liquidator, and that the said William Oram
Ball shall forthwith proceed to collect and realize the
assets of the Company, and apply the same in
discharge of its liabilities in a due course of adminis-
tration. It is also ordered that the costs of the said
petitioner, Alexander Carrick, of and attendant upon
his petition and this order be taxed by the proper
officer of this Court, and paid by the said William
Oram Ball to the solicitor for the said petitioner out
of the funds first coming to his hands in the said
estate. It is also further ordered that from and after
the date of this order, all suits and actions against
the Company be stayed.
Dated at Dunedin the twenty-seventh day of
September, one thousand eight hundred and sixty-
seven.
