mencing point.
In the Supreme Court of New Zealand, Otago and
Southland District.
In the matter of the petition of John Davidson of
Tokomairiro in the Province of Otago, Hotel
proprietor and General Dealer, a Debtor for relief
under "The Debtors and Creditors Act, 1862;"
and in the matter of the petition of John Reid, of
Dunedin, in the same Province, Commission Agent,
being a Creditor of the said John Davidson to
the extent of not less than fifty pounds within
the meaning of the said Act, and in the matter
of the said Debtors and Creditors Act 1862.
WHEREAS on the Thirty-first day of October
One thousand eight hundred and sixty-four,
upon reading the Petition of the abovenamed John
Davidson and John Reid and the Affidavit of the said
John Davidson thereunto annexed, and upon hearing
Mr. Turton of Counsel for the said Petition, it was
ordered that the said John Davidson should on or
before the Twenty-eighth day of November next or
within such extended time as this Court should grant
for that purpose convey assign and make over all his
real and personal estate and effects unto the above-
named John Reid, such conveyance and assignment
to contain all requisite powers for enabling the said
John Reid to recover and receive debts monies goods
chattels estate and effects in any way belonging to
or due and payable to the said John Davidson upon
trust for the purpose of selling disposing or getting
in and receiving or otherwise realising such estate
monies goods chattels and effects and thereout of
satisfying all costs charges and expenses incurred by
order of the Court or incidental to the execution of
such trusts and all fees of Court and such other sums
of money as should be ordered by the Court and
subject thereto for the purpose of distribution and
administration of such estate and effects by way of
pro rata distribution subject to existing legal priori-
ties between and amongst and for the benefit of such
of the Creditors of the said John Davidson as should
duly prove their respective claims by Affidavits filed
in the office of the Registrar of the said Court at
Dunedin within the space of three callendar months
from the date of the said order now in recital: And
whereas the said debtor John Davidson has executed
a Deed of conveyance and assignment of his estate
and effects in conformity with the terms of the said
recited order upon production of the said Deed, and
upon hearing Mr. Turton of Counsel for the said debtor
it is hereby ordered that the said John Davidson be
discharged and released from his debts liabilities
and engagements specified in the Schedule marked
"B" annexed to the said Petition.
