3. The Assessors to be appointed in the
foregoing cases shall be taken from persons
not interested in any way in the claims to be
affected by their decision.
4. In the event of the Assessors in any
case not coming to a decision, the decision
shall be left to the Commissioner or other
person or persons duly appointed to carry
these Regulations into effect.
5. The amount assessed in any of the
foregoing cases will be summarily recoverable
in the Resident Magistrate's Court.
6. The pay of each Assessor shall be fifteen
shillings (15s.) per diem, and shall be paid
by the person against whom such decision
is given.
Registration of Claims.
7. The three months for which proof is
required by sub-section (1) of section 23 of
the Regulations of the 15th Sept., 1863, that
a claim has been worked before it can be
registered, shall be the three months imme-
diately previous to application being made
for such registration.
Fees in certain Cases.

8. The fee for registration of

The item Juryman's pay per
diem 7s., in the Regulations of the
15th September, 1863, is hereby
repealed, and the pay in such case
shall be per diem 0 10 0

the thirty-first day of May next ensuing be
chargeable the following scale of Fees :-

recorded instrument, or deposited
memorial or instrument, for every

ment Act, 1858."

At the Government House, at Auckland, on
the nineteenth day of April, 1864.

HIS EXCELLENCY THE GOVERNOR IN
COUNCIL.
WHEREAS by an Act of the General
Assembly of New Zealand, intituled
"The Bay of Islands Settlement Act, 1858,"
the Governor was empowered to set apart
on the Western side of the Bay of Islands
an eligible site for a Settlement for coloniza-
tion, and to take for such Settlement certain
lands in the said Act specified, and within
such settlement to cause a Town to be
surveyed and laid out, and also suburban and
rural allotments; and it is further provided
by the said Act that all such town, subur-
ban, and rural lands shall be let, sold,
occupied, and disposed of, for such prices, in
such manner, for such purposes, upon such
terms, and subject to such regulations as the
Governor in Council shall from time to time
prescribe for that purpose: Now, therefore,
His Excellency the Governor, by and with
the advice and consent of the Executive
Council, and in exercise of the above power,
doth by this present Order make the follow-
ing Regulations for the purposes hereinbe-
fore recited.
