AT THE GOVERNMENT HOUSE AT AUCKLAND,
THE TWENTY-EIGHTH DAY OF JUNE, 1859.
Present :-
His Excellency the Governor.
Mr. Whitaker,
Mr. Richmond.
Mr. Tancred.
WHEREAS by the "Customs Regulation
Act, 1858," it is provided that it shall
be lawful for the Governor in Council by
Order in Council, published in the "New
Zealand Gazette," from time to time to suspend
during such time as may appear expedient, the
operation of any provision of the said Act,
or
either throughout the Colony, or in
at any particular district or port to be
defined or specified for the purpose; and also
to continue in force during such time as may
appear expedient, any provisions of any Ordi-
nance by the said Act expressed to be repealed.
And whereas by Order in Council dated the
1st day of January, 1859, the operation of
Sections 127, 128, and 129 of the said Act,
was suspended from the day of the date of the
said Order until the 30th day of June, 1859,
and by the same Order Section 53 of an Ordi-
nance enacted by the Governor of New Zealand
with the advice and consent of the Legislative
Council thereof, intituled "An Ordinance to
repeal within the said Colony of New Zealand
an Act of the Governor and Council of New South Wales passed in the third year of her pre-
sent Majesty's reign, intituled "An Act to repeal
an Act relating to the Revenue of Cus-
toms in New South Wales, and to provide
for the general regulation thereof; and
also, a certain other Act, of the said
Governor and Council of New South Wales,
passed in the fourth year of the reign of Her
said present Majesty, Queen Victoria, intituled,
"An Act for increasing the duties on Spirits,
Wine, and other goods and merchandize
imported into the Colony of New South Wales
and its Dependencies; and which said Acts of
the Governor and Council of New South
Wales were adopted, and are now in force
within the said Colony of New Zealand and
its Dependencies; and to make provision for the
collection of certain duties on goods imported
into, and for the general regulation of, the
Revenue of Customs in the Colony of New
Zealand and its Dependencies."
Now therefore, His Excellency the Governor,
by and with the advice and consent of his
Executive Council, doth by this present Order
further suspend the operation of sections 127,
128, and 129 of the said "Customs Regula-
tion Act, 1858," until the 1st day of January
1860, and doth continue in force until the
same day the operation of Section 53 of the
said Ordinance of the Governor and Legis-
lative Council of New Zealand.
