CONDITIONS.
All the articles required by this Notice are to be
of the best quality of their several kinds.
Vegetables to be supplied in reasonable propor-
tions of potatoes, greens, pumpkins, onions, &c. &c.
The supplies to be delivered on the requisition
of the Head of the Department for which they
are authorized.
The Supplies (not specified in the preceding par-
agraph) are to be delivered direct to the parties or
Establishments entitled thereto, on the written
order of the person duly authorised for the purpose.
In the event of a difference of opinion between
the Contractor and the party receiving the sup-
plies, as to the quality, the same is to be decided,
in cases where the article is not of a perishable
nature, by a Board of Survey, according to the
practice of the service.
If the Board shall decide that the article is not
of a proper quality, it must be immediately re-
placed by the Contractor, failing of which it will
be procured by the Department requiring it, and
the expense charge d to the Contractor.
In the event of any unnecessary delay or failure
of the Contractor to supply the articles when
required, they will be otherwise procured in like
manner.
In cases where the article is of a perishable
nature, or from some other cause, injury would
be sustained either by the parties to whom the
Rations are due, or to the Contractor, by waiting
for a Board of Survey, the head of the department
shall have power to reject such article or articles
as are obviously of inferior quality; it being dis-
tinctly understood that he will be responsible to
the Government for so doing; and that the Con-
tractor will have a right to appeal to the Governor,
although, in the mean time, he must take back
the rejected article and supply good in its stead..
A repetition of irregularity in the quality or
quantity of the supplies, or of any delay in deli-
vering or replacing them when required, will sub-
ject the Contractor, upon the report of the officer
in charge of the parties or establishment, to such
mulct, not exceeding one-fourth the amount of his
monthly account, as the Governor may direct.
It will also be in the power of the Governor, upon
such repetition, to terminate the contract.
It will be in the power of either party to limit
the duration of the contract, by giving in writing
a notice of three full calendar months to the op-
posite party, and to end the contract at the ex-
piration of that period.
The Contractor will be required to prepare his
own account, monthly or quarterly, in the pre-
scribed form; and on the production thereof, with
the requisite vouchers, in a complete state, to the
officer receiving the supplies, the same will be for-
warded by the latter to the Treasurer, in order
that a warrant may be prepared, and payment
made from the Colonial Treasury.
The value of all packages to be included in the
prices demanded.
Forms of Tender may be obtained at this
Office; and as adequate security will be required
for the due fulfilment of the Contract, no Tender
can be attended to unless accompanied by a cer-
tificate from the parties proposed as such, stating
that they are willing to become bound as secu-
rities for the Contractor accordingly, and the
bonds must be executed within ten days from the
day of acceptance of the Tender being notified,
failing of which the contracts will be again ad-
vertised, or another Tender accepted.
The Tenders to contain the names of the Ten-
derers and their Sureties, and places of residence,
at length.
All Tenders to be enclosed in a separate en-
velope, and marked "Tender for Provisions, &c."
Further particulars and information may be
obtained on application at this Office.
The Parties tendering, or an Agent for them,
are requested to attend at this Office, at the time
appointed for receiving the Tenders.

OTICE is hereby given, that a SPECIAL
PETTY SESSION of the Magistrates of
this Town and District, will be holden at the
Police Office, Auckland, on the first Tuesday in
the ensuing month of March, for the purpose of
considering any application which may be made
for the transfer of Publican's Licenses.
