tractor will have a right to appeal to the Governor,
although, in the mean time, he must take back
the rejected article and supply good in its stead.
A repetition of irregularity in the quality or
quantity of the supplies, or of any delay iu deli-
vering or replacing them when required, will sub-
ject the Contractor, upon the report of the officer
in charge of the parties or establishment, to such
mulct, not exceeding one fourth the amount of his
monthly account, as the Governor may direct.
It will also be in the power of the Governor, upon
such repetition, to terminate the contract.
It will be in the power of either party to limit
the duration of the contract, by giving in writing
a notice of three full calendar months to the op-
posite party, and to end the contract at the ex-
piration of that period.
The Contractor will be required to prepare his
own account, monthly or quarterly, in the pre-
scribed form; and on the production thereof, with
the reqnisite vouchers, in a complete state, to the
officer receiving the supplies, the same will be for-
warded by the latter to the Treasurer, in order
that a warrant may be prepared, and payment
made from the Colonial Treasury.
The value of all packages to be included in the
Prices demanded.
Forms of Tender may be obtained at this
Office; and as adequate security will be required
for the due fulfilment of the Contract, no Tender
can be attended to unless accompanied by a cer-
tificate from the parties proposed as such, stating
that they are willing to become bound as secu-
rities for the Contractor accordingly, and the
bonds must be executed within ten days from the
day of acceptance of the Tender being notified,
failing of which the contracts will be again ad-
vertised, or another Tender accepted.
The Tenders to contain the names of the Ten-
derers and their Sureties, and places of residence,
at length.
All Tenders to be enclosed in a separate en-
velope, and marked "Tender for Provisions, &c."
Further particulars and information may be
obtained on application at this Office.
The Parties tendering, or an Agent for them,
are requested to attend at this Office, at the time
appointed for receiving the Tenders.

Commanders of Vessels steering to or from the
Port of Auckland, should be careful to avoid the
undermentioned dangers :—
A Rock off the North side of the Island of
Waiheke, distant about four miles, even with the
water's edge at high water, with deep water ex-
tending to a short distance around it, from which the
following Bearings and Land Marks were taken :—
North-eastern end of Waiheke, due East (mag.)
Bird Island, E. by N. N.
Northern end of Huva Kia, W. S.
Peak of Rangitoto, S. W. W.
2, A Rock situate to the Eastward of the Island
of Tiri Tiri Mantangi, distant about one and a
half miles, having two feet of water on it at low
water, and fifteen fathoms close to on every side,
from which the following Bearings and Land
Marks were taken :—
A remarkably white rocky Islet at the North-
eastern side of Tiri Tiri Mantangi, N. W. by W.
W. (magnetic).
Southern end of Tiri Tiri Mantangi, S.W. W.
Centre of Little Barrier, inland, due North.
Peak of Rangitoto, S. E.
Castle Hill, E. S.

SALE OF LAND.
A T eleven o'clock on the Friday, the 30th day
of April next, the Colonial Treasurer will
put up to AUCTION, at the Treasury, the under-
mentioned portions of LAND, on the terms author-
ized by Government.
Further information respecting the LAND may
be obtained from the Surveyor General, and res-
pecting the conditions of sale from the Colonial
Treasurer.
