HOBSON HOTEL,
MATAVIA BAY, NEAR KORORARIKA.
Michael Fitzpatrick,
BEGS respectfully to inform his numerous friends and the Public generally, that he has opened the above house (which he has leased for a period of years) as an Hotel, for the accommodation of Gentlemen and Private Families visiting the Bay of Islands, and from the retired and pleasant situation of Matavia, combined with several excellent alterations and improvements already made, and also contemplated, he hopes that he will meet with a liberal share of public patronage. His exertions for the comfort of his friends and patrons, will be unwearied, to ensure a continuance of their favors.
The above Hotel is only five minutes' walk from the business portion of Kororarika, and on the high Road to Russell Town. Those who value health will do well to inspect Mr. F's accommodations and facilities for affording comforts; the walk, alone, and the quiet retirement from the bustle of business, may be well ranked among the inducements for Gentlemen and private Families taking up their residence at the “Hobson.”
N. B. Boats from the various Bays and Rivers in the Bay of Islands, in bad weather, when landing cannot be effected elsewhere, put in opposite the “Hobson,” where the waters are always still.
A boat always ready for those frequenting the Hotel.
Matavia Bay, near Kororarika, 16th Sept., 1840.
KORORARIKA:—October 1, 1840.
The Act has now been published which is proposed to be the basis of the Government of British Colony New Zealand. It may be useless for us to discuss this in the present state of affairs.
It is in spite of the evils of legislation at Sydney by persons who have no connexion with or interest in this country, that we live... little or nothing of their proceedings, till they come forth in the form of a law. We believe, these Acts require the confirmation of the Colonial Office before they can be put in force and in the hope that the Ministry may be induced to revise; if not to expunge the Act in question, we will venture to express our sentiments upon the subject without disguise.
It is our opinion, if the Colonists send home a Memorial, the Crown will by no means confirm this Act, for the following reasons:—
First of all, the essential principle and basis of the Act is directly opposed to the solitary object which the Ministers had in view in consenting to colonize this country. That object is most distant and prominent in the whole of the Marquis of Normanby's instructions—it cannot be misunderstood—it cannot be made second to any other in his Lordship's letter—it is the protection of the Native interests. It is true, that by Sir George Gipps' Act a violation of aboriginal rights is taken part of—but it is also equally and most notoriously true, that those rights are—we will not say, at the mercy of the Government—they are altogether mildered and overthrown by authority, and in such a manner, that they can never be recovered if this Act be once applied. If proof of this be required, take the following:
The Act is entirely founded on the non-recognition of aboriginal power over landed property, and of perfect political independence prior to the establishment here of the authority of the British Crown. There can be no question of this; Sir George Gipps in his speeches most unambiguously stated, that this was the ground of his proceeding. It is true that the express denial of the right in question has been withdrawn from the face of the Bill—but it is not the less evident that the whole of the Bill rests on the assumption that the Aborigines had no just, uncontroulable right to their lands.
