A Bill to Regulate the Occupation of the Waste Lands of the Crown, in the Province of New Ulster.

  1. Certain persons being Justices of the Peace to be appointed Commissioners of Crown Land.

  2. Appointment and tenure of office.

  3. Governor may make Rules for their guidance.

  4. Power to Commissioners to hear and determine disputes.

  5. Commissioners may award Damages not exceeding £20.

  6. And may expel trespassers.

  7. And may distrain for rent, &c.

  8. And may charge a fee for his decision.

  9. Fees to be paid into the Treasury.

  10. Return of Stock to be made by owner.

  11. Assessment to be levied on Stock.

  12. Commissioner shall make yearly report to Treasurer of such assessment.

  13. Notice to be given to the party liable to assessment.

  14. Amount due to be recoverable by distress.

  15. In case of non-payment License to be cancelled.

  16. Right of Pasturage to be limited to persons holding a License.

  17. License to be granted to an occupant.

  18. License to be in force for one year.

  19. Fee to be paid for license.

  20. List of Licensed persons to be published in Government Gazette.

  21. Persons comprised in such list to have exclusive right of pasturage.

  22. And are to have the power of electing Wardens.

  23. Commissioner to preside at Elections.

  24. And to have casting vote.

  25. Vacancies how to be supplied.

  26. Wardens to have power to apportion, &c., cattle to be depastured.

  27. Regulations made by Wardens to be published.

  28. Failing an appointment by Wardens, Commissioner to have the power.

  29. Power to Wardens to make Bye-Laws.

  30. And to levy an assessment.

  31. And to distrain for the same.

  32. Accounts to be kept by Wardens.

  33. Penalty on unlicensed persons depasturing cattle.

  34. Power of Wardens to impound Cattle trespassing.

  35. Persons occupying Crown Lands without License liable to penalty.

  36. Penalty for a second offence.

  37. Exception.

  38. Right of the Crown saved.

  39. Cattle Trespassing may be impounded.

  40. In actions, suits, or proceedings under the Ordinance the proof that the occupation or use in question is authorised by Provisions of this Ordinance shall be on defendant.

  41. Costs of Suit may be paid out of the Public Treasury.

  42. Interpretation.

Additional Provisions

  1. Value, how ascertained.

In every such case as aforesaid the value of the land so given up by such person shall be determined by two Appraisers, one to be appointed by such Governor or other Officer, and the other by the person entitled to such right of selection, and the value of the Land hereby authorised to be given in Exchange, shall be ascertained and determined by the upset price at which it may last have been offered for sale by public auction as aforesaid.

  1. Ordinance not to come into operation until it receive Royal assent.

This Ordinance shall not come into operation until it shall have received the Royal Confirmation, and until such confirmation shall have been duly notified in the New Zealand Government Gazette.
