Colonial Secretary’s Office,
Auckland, June 26, 1849.
His Excellency the Governor-in-Chief has been pleased to direct that the following report and suggestions be published for general information.
By His Excellency’s command,
ANDREW SINCLAIR,
Colonial Secretary.
MEETING OF WARDENS OF THE PANMURE HUNDRED.
Present—
MR. KERR,……MAJOR GRAY,
THE BISHOP OF NEW ZEALAND.
THE Bishop reported that the resignation of Lieutenant Gray had been formally reported by the Commissioner of Crown Lands.
Mr. Kerr proposed Major Gray to be elected as Warden in the room of Lieutenant Gray, resigned.
Major Gray was accordingly elected; and took his place at the meeting.
Read the instructions in the Government Gazette, of 2nd November, 1848.
Read Return of Waste Lands in the Hundred of Panmure; reported as amounting to 1737 acres.
Estimated extent of Western Division, 1000 acres.
Estimated extent of Eastern Division, 700 acres.
It appeared to the Wardens, upon the best information which they could procure, that the Waste Lands in the Western Division would probably maintain one hundred head of large cattle, or five hundred sheep.
And that the Eastern Division, being of better quality, would maintain the same number.
That the principle of right of pasturage be regulated according to the English Law of Common, by which, right of common is regulated according to the state of cultivation and capability of the private land held by each claimant, for maintaining stock, if it should be required at any time to be taken off the Common; the preference being given in all cases to the smaller holders, as having paid an equal amount for their licenses.
That the Common right be transferable to any other person, provided that the number pastured by any person, or under his permission, shall not exceed the whole number to which he is entitled.
That one half of the number to which each person is entitled be pastured in the Western Division, and the remainder in the Eastern Division.
That persons rated for three cows and under, may pasture all their cows in one division.
That, for the purposes of this distribution, five sheep shall be considered as equal to one head of horned cattle.
That, for the present, till more accurate returns of the state of cultivation of the lands in the district can be obtained, the following be the number of head of cattle which each person holding a license will be permitted to depasture.
