New Zealand, by enactment, subject to such conditions as aforesaid, to authorize the Legislature of the Province in which Nelson is or may be situate to exercise all or any of the powers by this Act granted to the said Legislature of New Zealand in reference to the said Fund.

As to cases falling within Section 51 of 9 and 10 Vict. c. ccclxxxii. Grants of the Crown to be of the like Force as Conveyances by the New Zealand Company.

10. That henceforth in all cases falling within the provisions of the fifty-first Section of an Act of the Ninth and Tenth of Victoria, intituled "An Act to grant certain Powers to the New Zealand Company" a grant or Conveyance by Her Majesty, Her Successors or Assigns, shall have the like force and effect in all respects as a Conveyance by the New Zealand Company has or would have had by virtue of the same Act in case no such Notice as aforesaid had been given and the said Company had continued in the full exercise of their functions; and the powers by the same Act in reference to those cases conferred on a Nominee or Nominees of the said Company, approved of as therein mentioned, shall henceforth be exercisable by such person or persons as the Governor or Lieutenant-Governor for the time being of New Zealand may from time to time appoint; and that all Acts done in pursuance of any such several powers by the party or parties for the time being entrusted with the execution thereof shall be binding on Her Majesty, Her Successors and Assigns.

Saving of the rights of the New Zealand Company under 10 and 11 Vict. c. 112.

11. Provided always, that nothing herein contained shall be construed to affect or interfere with the rights of the New Zealand Company in respect of the sum of two hundred and sixty-eight thousand three hundred and seventy Pounds fifteen Shillings, and Interest, which by the said Act of the Tenth and Eleventh of Victoria are charged upon and to be paid to the said Company out of the proceeds of all future Sales of the demesne lands of the Crown in New Zealand, after such deductions as in the said Act specified, or any rights which the said Company may now possess in regard to the proceeds from the disposal of land in either of the said settlements.

Interpretation of Terms.

12. That the words "Governor of New Zealand" and "Lieutenant-Governor" in this Act shall be deemed respectively to mean the persons for the time administering the general Government of the Islands of New Zealand or the Government of any Province thereof.

THE COOK'S STRAIT SETTLEMENTS.

Terms of Purchase of Land, until further Notice.

The Court of Directors of the New Zealand Company are prepared to dispose of Land in the settlements of Wellington Nelson and New Plymouth, on Cook's Strait in New Zealand, under the following Terms, until further Notice.

Size and Price of Allotments.

1. The Allotments of Land in the settlements of Wellington, Nelson, and New Plymouth, and their Prices including the Special Contributions for Emigration and other purposes mentioned in Paragraph 2, will for the present be respectively as stated below.

The Allotments are to be taken at the contents in Acres marked in the documents issued by the Company, or by its Principal Agent in New Zealand or other authorised Officer, be the same more or less.

The Purchase of the Surface will include Coal and all other Minerals whatever, granted to the Company by the Crown and lying underneath the Allotment purchased.

When any Suburban Allotments are laid out and opened for selection, in the vicinity of any Town or Village, the Prices will be stated.
