Sir,—The List of Electors, for 1851-52, for Commissioners for the Town of Wellington, having been this day revised by the Bench of Magistrates, I have the honor to request instructions previous to the publication of notice by the Resident Magistrate for the Electors to assemble for the mode of proceeding in such election. The Ordinance does not define the manner in which the votes are to be taken; how the list is to be prepared; or who is to be the Returning Officer.

Sir,—In reply to your letter of the 13th instant, requesting instructions, with respect to the election of Road Commissioners for the Town of Wellington, as to the manner in which the votes are to be taken, how the list is to be prepared, and who is to be the Returning Officer; I am directed to inform you that His Excellency the Governor-in-Chief has caused the opinion of the Attorney General to be taken on the following points:—
1st. Whether the law is defective in the particulars referred to by the Resident Magistrate.
2nd. If such is the case, who has the power under the Ordinance, or any other law, to determine the same.
The manner in which the votes are to be taken:
The mode in which the lists are to be prepared, and who is to be the Returning Officer:
The opinion of the Attorney-General is to the effect that, “the Ordinance is defective in not enacting what manner the election of the Commissioners shall be held, and the defect cannot be cured by any authority not equipped with that which made the Ordinance, viz., a Legislative Council.”
I am further to request you will be good enough to communicate this opinion to those members of the Bench of Magistrates who signed the requisition for the Proclamation of the Ordinance in question.

OWNERS of Boats and Vessels belonging to this Port are hereby required to take notice that, from and after the 10th day of October next ensuing, the 52nd and 54th clauses of the Ordinance of the Governor and Council of New Zealand, 4th Victoria, No. 3 of 1841, will be rigidly enforced.
