PROCLAMATION.
By His Excellency Howan John Eyre, Esquire, Lieutenant Governor of the Province of New Munster, in the Islands of New Zealand, &c., &c., &c.
WHEREAS by certain Letters Patent under the Great Seal of the United Kingdom bearing date the 28th day of December, 1846, full power and authority was vested in the Governor of New Zealand, with the advice and consent of the respective Executive Councils thereof, to issue proclamations apportioning the limits of Counties, Hundreds, Rides, Wapentakes, or other divisions of the said Islands:
And it is further declared that the Letters Patent shall be deemed and taken to empower His Excellency the Governor for the time being of such Province, and the Governor of New Munster:
And whereas by an Ordinance enacted by His Excellency the Governor of New Zealand, by and with the advice of the Legislative Council thereof, Session 8, No. 17, intituled, “An Ordinance for imposing a Tax upon Rangoon Spirits,” it is provided, that it shall be lawful for His Excellency the Governor from time to time by Proclamation to declare the boundaries of each County, Hundred, Riding, Wapentake, or other subdivision that “on a day to be named in such Proclamation, not being less than six calendar months from the date thereof,” there shall be levied in respect of any buildings or establishments wholly or in part adapted or used for the sale by retail of spirits of any description within the Province of New Munster, the following duties, that is to say:
And whereas it is expedient that Ordinances now enacted by the Lieutenant-Governor of New Zealand, by and with the advice of the Legislative Council thereof, Sess. 7, No. 17, intituled, “An Ordinance to repeal the Ordinance of the Governor and Legislative Council of New Zealand intituled ‘An Ordinance to provide for the registering of vessels of the colony, and for other purposes’ of the session of the said Council,” should be amended:
Now therefore I, the Lieutenant Governor of the Province of New Munster, in pursuance of the powers vested in me, do hereby proclaim and declare that the boundaries hereafter respectively shall be defined by such Proclamations and further that “on a day to be named in such Proclamation, not being less than six calendar months from the date thereof,” there shall be levied in respect of any buildings or establishments wholly or in part adapted or used for the sale of spirits by retail in any town or township within the Province of New Munster, and the same shall be collected as follows:
And whereas it is expedient that Ordinances enacted by the Lieutenant Governor of New Zealand, and by and with the advice of the Legislative Council thereof, be amended, I do hereby proclaim that every Cattle Trespass Ordinance and the Cattle Trespass Amendment Ordinance shall be repealed, and in lieu thereof the following provisions of compensation for damage done by cattle trespassing shall have effect within the Province:
Any person whose cattle shall be found wandering in days in the street or public place within the limits of any town or village which shall be proclaimed by the Governor to constitute the operation of this present proclamation, the owners or keepers of such cattle so trespassing and found wandering shall forfeit and pay for every head of cattle so wandering any sum not exceeding five shillings, to be recovered in a summary way.
