IT is hereby notified, that, in accordance with Section 20 of "The Education Act, 1863," I have appointed
ALFRED GREENFIELD, PROVINCIAL SECRETARY,
a member of the Central Board of Education for the Province of Nelson.

PROTECTION is hereby GRANTED, subject to the following conditions, for SIX YEARS from this date, under the Provisions of "The Goldfields Act, 1866," to "The Buller Towing Track Company (Limited)," for a TOWING PATH to be constructed up the Buller river, from Garden Island on the south bank of the Buller to the junction of the River Inangahua; and the said Company are hereby authorised to charge the TOLLS hereinafter specified, during the continuance of this Protection.
CONDITIONS:

That a good Towing Path or Track shall be constructed from Garden Island to the junction of the Inangahua river with the Buller, under the direction and to the satisfaction of the Provincial Engineer.

That the Track shall be completed on or before the 31st December, 1871, and shall be maintained in good order by and at the expense of the said Company during the whole of the said term of Protection, to the satisfaction of the Provincial Engineer.

That the Tolls to be charged shall be at a rate not exceeding One Pound per Ton.

The Protection shall not interfere with the navigation of the Buller river, by Boats not using the Towing Path.

The Towing Path shall be open to all persons desirous of using the same, on payment of the Tolls.

The Government to have the option, at any time, on giving Three Months notice, of taking the Track, either at a valuation or at Ten per cent advance on the first cost of construction, exclusive of cost of repairs, and if taken at a valuation, the value of the work only to be taken, exclusive of good-will.

At the expiration of the said term of Six Years this Protection will cease and determine, and the Company will not be entitled to any compensation.

In the event of any of the above conditions not being carried out to the satisfaction of the Superintendent, he may cancel this Protection, and the said Company shall not be entitled to any compensation or payment.

This Protection shall not be transferred without the sanction of the Superintendent of the Province.
