Nelson, 31st December, 1868.

DANIEL M'LEOD, of Westport, is hereby authorized, under the provisions to Section XIII. of the Goldfields Act, 1866, to construct a Wharf, 40 feet long and 30 feet broad, opposite Bright-street, Westport, and to charge not exceeding the under-mentioned tolls for a period of five years from this date, on the following terms and conditions, viz.:β€”

  1. The Wharf shall be completed within three months from this date, and shall be maintained in good repair during the term of this protection.

  2. The Wharf shall be subject to the provisions of the Harbor Regulations which may from time to time be in force in the River Buller.

  3. The sum of Five Pounds shall be paid annually to the Warden of the District by the Lessee.

  4. Should the Government consider it necessary for the construction of protective works, or for any other public purpose, the Superintendent shall have power to cancel this protection at any time; and the Lessee shall in that case be paid the value of the Wharf at the time of such cancellation, but the Lessee shall not be entitled to compensation beyond the actual value of the structure, which shall be ascertained in the usual way.

  5. This protection shall not be transferred without the sanction of the Superintendent.

  6. The Warden of the District shall have power, on being satisfied that the Wharf is not in a good state of repair, or that any of the above conditions have been violated, to suspend the operation of this protection until the matter of complaint be removed, or the protection cancelled.

If any Vessel lying alongside the Wharf shall receive or discharge Goods or Stock otherwise than from or upon the Wharf, half wharfage may be charged on all such Goods or Stock so received or discharged.
