Nelson, 30th November, 1863.

PETER JAMES M'KENNA is hereby
authorised, under the provisions of
Section XIII. of the Goldfields Act, 1866,
to construct a track from the Plains at the
North end of Giles' Terrace, through the
bush, across Deadman's Creek, and up the
North bank of the Creek, being a distance
altogether of about a mile and a quarter to
the present workings in Deadman's Creek,
and to charge for a period of six months
from the 1st December, 1863, tolls accord-
ing to the Schedule on the following con-
ditions :—

  1. That the track shall be maintained at
    all times in a good state of repair.

  2. That any other person at any time on
    payment of a proportionate share of
    the construction of the track at a
    valuation may become a part pro-
    prietor in it.

  3. That this protection does not interfere
    with any ground held under any
    existing rights and privileges nor
    prejudice the right of the Govern-
    ment to cut any other track provided
    that no protection shall be granted
    for any other track to approach
    nearer than one chain to this one.

  4. That all Government officers, including
    road overseers and laborers and post-
    men when on duty shall use the track
    free of charge.

  5. That this protection shall not be trans-
    ferred without the sanction of the
    Warden of the District.

  6. That the Warden of the District shall,
    on being satisfied that the track is
    not in a good state of repair, or that
    any of the above conditions have been
    violated, have power to suspend the
    operation of this license until the
    matter of complaint be removed:—
