Land Settlement Terms




Hawke’s Bay, being a portion of the Maharahara Block, and containing by admeasurement two thousand (2000) acres, more or less. Bounded towards the East and South-east by the Oringi Waiaruhe Block, 1575 links, 7260 links, and 10,800 links; towards the North-east by the Tahoraiti Block No. 1, 2640 links, 2783 links, and 875 links; towards the North by a portion of the Maharahara Block, being a line running westerly from Manawatatua on the western boundary of Tahoraiti Block No. 1, a distance of 10,500 links; towards the West by a portion of the Maharahara Block, being a line running southerly a distance of 20,000 links; and towards the South by the northern boundary of the Ahuaturanga Block, 8500 links.

SECOND SCHEDULE.

Terms and Conditions for Occupation and Purchase of the Block of Land proposed to be set aside for Special Settlement by the Heretaunga Small Farm Association.

  1. The object of this Association shall be the establishment of a Small Farm Settlement in the Maharahara Block, in the Province of Hawke’s Bay.

  2. The business of the Association shall be managed by a Committee of seven members, including the Secretary and the Treasurer, to be elected by the shareholders annually, whose duty shall be to carry out the object of the Association. The Secretary shall act as Manager, and shall have charge of all books and other property, and shall carry out the instructions of the Committee and general meeting, and shall receive and answer all correspondence for this Association.

  3. No question of vital importance to the Association shall be decided by the Committee so as to bind the members, unless resolved upon at a general meeting of members, due notice of which shall be given; and all questions carried and decided upon by a majority of the members then present shall be binding upon the Association, unless contrary to the rules and laws under which the Association shall be formed.

  4. The members of the Association shall be males not under twenty-one years of age, who shall not hold less than thirty shares, and shall undertake to occupy and pay for the land in conformity with these regulations, and also in conformity with the terms laid down by the Government and Provincial Council of Hawke’s Bay, and terms as agreed upon by His Honor the Superintendent on their behalf.

  5. Occupation shall be the enclosing of at least 10 per cent. of the land taken up by each shareholder, and clearing the same, and the erection of a tenement, the value of which shall not be less than ten pounds (£10), before the end of the second year; and further, that at least 20 per cent. of the land taken up by each shareholder shall be enclosed with a good and substantial fence, cleared and put into crop before the end of the fourth year; clearing to mean that all trees less than ten (10) inches in diameter at three (3) feet from the ground shall be felled, and also the actual residence of a member, himself or his family, during the whole of the third, fifth, and seventh years of the term.

  6. The settlements shall be divided into allotments not exceeding one hundred and fifty acres each, according to the requirements of the shareholders, together with reserves (if required) for public or educational purposes, which will be laid out by the Government.

  7. Each share shall represent one acre of land, and no member shall subscribe for or occupy more than one hundred and fifty acres or less than thirty acres.

  8. Every member of this Association shall pay an entrance fee of twopence (2d) for each share at the time of entrance, towards the general fund of this Association.

  9. The allotment of sections shall be made at a general meeting of the Association, and in such manner as shall be agreed to by a majority of the members attending such meeting.

  10. The price of each acre shall be one pound (£1) sterling, payable every three months, at the rate of ninepence (9d.) per share for each and every share, until the member shall have paid one pound (£1) sterling for each and every share he may hold. Any member will be at liberty to pay larger instalments, or the whole balance of purchase money in one payment, after he has complied with Rule No. 5 as far as refers to improvements and the residence on his section the third year.

  11. Each member shall pay, or cause to be paid, his instalments from time to time to the Treasurer, whose receipt shall be sufficient voucher for such payment. Payment shall be made on the twentieth day of June, on the twentieth day of September, on the twentieth day of December, and on the twentieth day of March, in each year.

  12. Any surplus money arising from the fines, entrances, or levies shall be applied by the Committee to the payment of expenses which have been and will be incurred in establishing and carrying out this Association, and to any other purpose which a majority of
