In the matter of the Petition of LEMUEL SAYWELL, of Napier, in the Province of Hawke's Bay; and in the matter of the Debtors and Creditors Act, 1865; and in the matter of the Debtors Act Amendment Act, 1866.

On Friday, the 21st day of June, 1867.

ON reading the petition of Lemuel Saywell and the affidavits of Edward Lyndon G. Ashley and Lemuel Saywell filed herein and on hearing Mr Pharazyn of counsel for the said Lemuel Saywell it is ordered that the said petition be accepted and that the estate and effects of the said petitioner be sequestrated in the hands of the Inspector in Bankruptcy for the said Province of Hawke's Bay and that the said petitioner do come up for hearing before His Honor Mr Justice Johnston at the Supreme Court House Napier on the first practicable sittings of the said Court at the hour of ten o'clock in the forenoon and that a meeting of the Creditors of the said petitioner be held at the office of J. N. Wilson Esquire in Napier aforesaid on Monday the 15th day of July instant at the hour of 12 o'clock in the forenoon for the purpose of recommending Trustees of the said estate and effects and the mode of winding up the said estate and that the said Inspector in Bankruptcy be appointed ad interim Sequestrator of the said Estate and it is further ordered that this present order shall be a vesting order as provided by the Debtor's and Creditor's Act Amendment Act 1865 provided however that nothing herein contained shall protect the person of the said petitioner from any writ of arrest which may issue against him under the Writ of Arrest Act to the satisfaction of a Judge of this honorable Court or of a Registrar thereof in the absence of a Judge.
