Order in Council at the Provincial Government Buildings, Christchurch, the Thirtieth day of September, one thousand eight hundred and seventy-five.
WHEREAS by an Act of the General Assembly of New Zealand, intituled "The Salmon and Trout Act, 1867," it is among other things enacted that it shall be lawful for the Governor, from time to time, as may become necessary, to make such regulations as to the Governor seems expedient for prohibiting or restricting from time to time for any period which the Governor thinks necessary, fishing in any river or stream in which young salmon, salmon fry, or spawn, or young trout, trout fry, or spawn, is placed or deposited, or at the mouth or entrance of any such river or stream:
And whereas by Section 12 of the said Act the Governor may, by Order in Council, under his hand and the public seal of the Colony, from time to time delegate to the Superintendent or the Provincial Executive of any Province all or any of the powers vested in the Governor, or the Governor in Council, by the said Act:
And whereas the said Governor hath, with the advice and consent of the Executive Council of New Zealand, delegated to the Executive Government of the Province of Canterbury all the powers vested in the Governor, or the Governor in Council, by the said Act, exercisable within the said Province:
Now, therefore, his Honor RICHARD JAMES STRACHAN HARMAN, Deputy-Superintendent of the Province of Canterbury, with the advice and consent of the Executive Council thereof, doth, by virtue and in exercise of the powers delegated to the Executive Government of the said Province of Canterbury, and of every and any other power in any wise enabling the Provincial Executive in that behalf, hereby make the Regulations following, that is to say:

It shall be lawful for any person, upon obtaining from the Secretary of the Canterbury Acclimatisation Society a license under his hand authorising him so to do, to fish for trout with rod and line in the River Avon, from its source to New Brighton.

All trout taken by any person so fishing as aforesaid, and not exceeding eight inches in length, shall be immediately returned alive to the said river; and any person convicted of infringing this regulation shall be liable to a penalty not exceeding Twenty Pounds sterling, and his license shall become void.

A fee of One Pound sterling shall be paid to the said Secretary of the said Society on the issue of every such license.

Such license shall continue in force from the date of its issue until the 31st day of March, 1876, and no longer, and shall not be transferable.

Otherwise than as provided by the foregoing Regulations, no person shall fish in the said River Avon; and any person offending against this Regulation shall be liable to a penalty not exceeding One Hundred Pounds sterling.

The last preceding Regulation shall not apply to fishing for whitebait with nets.
