✨ Regulations and Land Deed

I. If any person shall import, drive, or remove, or cause to be imported, driven, or removed, or assist in driving or removing, any cattle from either of the said infected districts into the Province of Canterbury, except upon Quarantine ground and the authority of a Quarantine certificate, such person shall be liable to a penalty of not less than five pounds and not exceeding fifty pounds for every head of cattle so imported, driven, or removed.

II. It shall be lawful for any Inspector of Cattle or Police Constable to destroy, or cause to be destroyed, any cattle which shall pass into this Province from either of the said districts, contrary to these Regulations.

III. If any person shall wilfully impede or obstruct any Inspector or any Police Constable acting under the authority of these Regulations, every person so offending shall be liable to a penalty of not less than five pounds and not exceeding fifty pounds.

IV. These Regulations shall take effect from and after the day following the date of publication in the New Zealand Gazette.

THIS DEED made the third day of October One thousand eight hundred and seventy-one between Robert Heaton Rhodes of Christchurch in the Province of Canterbury in New Zealand Esquire of the first part the said Robert Heaton Rhodes and William Donald of Lyttelton in the said Province Esquire of the second part and Henry Phillips of Rockwood in the said Province Sheepfarmer of the third part and William Rolleston Esquire Superintendent of the said Province of Canterbury of the fourth part:

Whereas by Deed bearing date the tenth day of August One thousand eight hundred and sixty-seven and made or expressed to be made between the said Henry Phillips of the first part the said Robert Heaton Rhodes of the second part and the said Robert Heaton Rhodes and William Donald of the third part the parcel of land hereinafter described was inter alia conveyed and assured unto the said Robert Heaton Rhodes and Robert Heaton Rhodes and William Donald by way of Mortgage to secure unto the said parties thereto of the second and third parts the repayment by the said Henry Phillips of certain sums of money and interest thereon at the rates and at the times and in manner therein mentioned.

And whereas the said Henry Phillips having agreed to convey the said parcel of land hereinafter described for the purposes of a Public Highway in order to convey and assure the fee simple and inheritance thereof free from incumbrances has requested the said parties hereto of the first and second parts to join herein for such purpose which they have agreed to do.

Now this Deed witnesseth that in pursuance of such agreement and in order to carry out the same, the said Robert Heaton Rhodes in consideration of the sum of five shillings on the execution hereof paid by the said William Rolleston to the said Robert Heaton Rhodes (the receipt whereof is hereby acknowledged) and at the request and by the direction of the said Henry Phillips doth hereby convey and assure, and they the said Robert Heaton Rhodes and William Donald in consideration of the sum of five shillings on the execution hereof paid by the said William Rolleston to the said Henry Phillips (the receipt whereof is hereby acknowledged) do hereby convey and assure unto the said William Rolleston and his successors Superintendents of the said Province all that piece or parcel of land being part of rural section No. 16 on the map of the Chief Surveyor of the said Province setting out and describing the rural land in the Christchurch district thereof commencing at a point being ten chains eighty-five links south from the River Road reserved on the south side of Wilson's Bridge on the east of the Hill's Road thence north-easterly a distance of about twenty-six chains thirty-seven links to the said road reserved along the River Heathcote thence southerly along the said reserved road a distance of about one chain thence south-westerly in a straight line about thirty-seven chains seventy-six links to an angle in the roadway thence north-westerly to the opposite angle of the said roadway about one chain thence north-easterly to the commencing point a distance of about twelve hundred links as delineated in the plan hereon and therein colored pink together with the appurtenances to the same belonging and all the estate right title and interest claim and demand of them the said Robert Heaton Rhodes Robert Heaton Rhodes and William Donald and Henry Phillips or any of them therein and thereto to hold the same unto and to the use of the said William Rolleston and his successors Superintendents of the said Province for ever freed and discharged from the said recited Deed of Mortgage and from all claims and demands thereunder whether legal or equitable upon trust nevertheless for the purposes of a Public Highway.

And it is hereby declared and agreed that no covenants for title shall be herein implied on the part of the said parties hereto of the first and second parts save that they have done no act to encumber the premises.
