I hereby certify that to the best of my belief the above Bye-Law is in compliance as regards the Borough of Lyttelton, with the 184th section of the Municipal Corporations Act, 1867.

REGULATION—BUILDINGS.
The Council of the Borough of Lyttelton hereby make the following Regulation under Part V., Schedule 13 of “The Municipal Corporations Act, 1867,” that is to say:—

After the coming into force of this Regulation it shall not be lawful to lay the foundation or to proceed in the erection of any new building within that portion of the Borough described in the Schedule to this Regulation until after the expiration of three clear days’ notice in writing signed by the person intending to erect such building, shall have been delivered to the Clerk of the Council, stating such intention, and describing the site on which it is intended to erect such building, and for the purpose of this Regulation the words “new building” shall be deemed to mean any building which at the time of this Regulation coming into force shall not have been commenced to be erected, or of which the foundation shall not be completed ready to receive the external walls, or of which the materials intended for such external walls shall not be prepared and delivered on the premises comprising the site of such building ready to be erected.

The party walls or main side walls, as the case may be, of every new building to be erected within the district aforesaid, shall be constructed of brick, stone, iron, or other incombustible material, and the foundation of such building shall rest closely on the solid ground, or on concrete, asphalte, or other solid substructure.

The flat gutter or roof of every new building, and every turret, dormer, lantern, light, skylight, or other erection, placed on the flat or roof thereof, shall be externally covered with slates, tiles, metal or other incombustible material.

It shall not be lawful for any person, after ten years from the coming into force of this Regulation, to use, keep, continue or suffer to remain, any building originally constructed or made, without violation of law, and existing at the time of the coming into force hereof, being of any such construction, materials, or description, as are contrary to this Regulation.

The fees chargeable under this Regulation shall be for survey and general supervision of each building One pound one shilling; and for any subsequent survey rendered necessary by negligence or otherwise of any builder or other person Two pounds, or such lesser sum in each case respectively as the Council may order.
SCHEDULE.
All that block of land commencing at a point on the Beach, being the south-western corner of St. David’s street; thence along the western side of that street to the south-eastern corner of town section 175; thence along the southern boundary of that section and of section 173 to Winchester street; thence along the southern side of that street to Dublin street; thence along the eastern side of Dublin street to the sea; and thence along the southern boundary of the Borough to the starting point.
