✨ Waste Lands Regulations Amendments

IN accordance with the provisions of
the Waste Lands’ Act the following
amended Regulations for the management of the Waste Lands of the Crown
within the Province of Canterbury, are
published for general information previously to being proposed to the Provincial Council for their adoption.

Amendments to be Proposed by the Provincial Secretary.
Clauses 67 and 68 to be expunged,
and the following substituted:—

Pasturage Licences with Pre-emptive Right in connection with purchased Lands, whether under the Canterbury Association or the Crown, shall
from and after the first day of April,
One thousand eight hundred and fifty-six, be taken and deemed to be Pasturage Licences over the lands included
therein upon the terms of these Regulations with a Pre-emptive right over
all such land, to be exercised subject
to these Regulations as regards notice
of application, payment of deposit,
purchase money, price of land, and size
and shape of blocks. If the land
covered by such pre-emptive right shall
be included within the limits of a run
hold by licence under clauses 50 and 53
the holder thereof in paying rent for
the same may take credit for the
amount paid by him in respect of lands
covered by such pre-emptive right. -
Holders of Pasturage Licences
without Pre-emptive Right shall be
entitled to hold such licences or to have
them renewed upon the terms of their
contract with the Canterbury Association or the Crown, as the case may be.
But if any person holding a Licence
under the Canterbury Association or
the Crown shall voluntarily resign the
same, he shall be entitled to receive a
licence under these Regulations, and
shall from the date of such exchange
hold his run at the rate and on the
conditions specified in these Regulations.

Amendments to be Proposed by Mr. Barker.
Addition to Clause 1.
Add “so far as they are repugnant
to the Provisions of these Regulations,”
Addition to Clause 2.
At the end of Clause 2 insert “except as hereinafter provided,”
Omit Clause 43, and insert
“If any person shall, with the permission of the Provincial Executive Government, at other than the public cost, make, complete, or repair, or
cause to be made, completed, or repaired, any work of public utility
in the Province of Canterbury, such
person shall, upon application to the
Waste Lands’ Board, and upon producing a certificate signed by the Superintendent for the time being, certifying that such work has been so completed and is approved of by the Provincial Engineer, be entitled to claim
and shall receive a free grant of rural
land in such situation as he shall select
equal in value to the work so executed
at the current price of such land to an
ordinary purchaser. The selection to
be made subject to the conditions as to
choice, form, and frontage, contained
in these regulations.
Provided always that the value of
to the public of such work for which
compensation is claimed shall be estimated by the Provincial Engineer, and
the amount of compensation granted
shall be determined in accordance with
his certificate to that effect. Provided
also that if the quantity of land so
granted be less than 20 acres in extent,
the grantee or his assigns shall purchase
at the current price such quantity of
land as the section shall be deficient
of 20 acres, anything to the contrary
in these regulations notwithstanding.”
New Clause to be inserted after Clause 44.
Whereas it is of importance to the
prosperity of this Province that free
immigration be encouraged as much
as possible:—Be it enacted that in
case any person shall prove to the
satisfaction of the Waste Lands’ Board
that he has immigrated to this Province
subsequent to the passing of these
